Passengers on motor cycles
102. If any person in addition to the driver is carried astride a two-wheeled motor cycle on a road (whether a sidecar is attached to it or not) suitable supports or rests for the feet shall be available on the motor cycle for that person.

23 Restriction of carriage of persons on motor cycles.
(2) No person in addition to the driver may be carried on a motor bicycle otherwise than sitting astride the motor cycle and on a proper seat securely fixed to the motor cycle behind the driver’s seat.
That's all that I'm aware of. There's no requirement as to age or competency. You can even sit backwards as long as you're "astride".
Aside, I've just seen that the Highway Code online has finally started linking directly to the appropriate sections of the cited legislation.

Not spot on, it says they should have both feet on the footrests. Nowhere does it say they MUST have both feet on the footrests.
If you're saying it's illegal to ride a bike without both feet on the footrests then that implies it's also illegal for a pillion to face backwards (it's mentioned in the same sentence), which it isn't (camera men). ____________________ Yamaha TDM 850 |

Well if there are hair-splitting trollers crawling out from under something then I'll have to be a bit more careful wot I rote then.
I never said anything was 'illegal'.
There are many 'rules' in the Highway code book. Not many are actual 'Law'.
But almost everyone of them carries a substantial chunk of weight as evidence against anyone who disregards the 'rules'.
Most people know or should know this.
Unless they passed their test before the 1930s.
Again for the hard of thinking:
"Rule 85
You MUST NOT carry more than one pillion passenger who MUST sit astride the machine on a proper seat. They should face forward with both feet on the footrests. You MUST NOT carry a pillion passenger unless your motorcycle is designed to do so. Provisional licence holders MUST NOT carry a pillion passenger.
Laws RTA 1988 sect 23, MV(DL)R 1999 reg 16(6) & CUR 1986 reg 102"
'Must' is probably where there is a Law.
'Should' is probably where a court would take a view that someone was being careless when the advice is ignored.
My 2p worth
I don't think there is any 'real' necessity to carry a child on a motorcycle if they can't get their feet on the BIKE foot rests.
Modificating a bike to carry a smaller person via some adapted or fabricated apparatus/contrived equipment will leave too many problems in regards to compliance with C&U regulation, guidance and laws.
If you are dumb enough and fancy having a go then blooter on regardless.
For certain, most other, reasonably minded, people will consider the rider to be a bit of a dangerous twat/eccentric weirdo.
And the PoPo will stop you at every operchancity.
Maybe no law to hammer you with but it is still not making good progress having to stop, get off, do the ID, Ownership and Ins. check and the ear-ache.
They will most likely feel a need to stop you.
