Lovable rogue? Not really. He's the scum in the gene pool and should be scooped out if at all possible.

Kinsella, nicknamed Tush, has 14 previous convictions for 31 offences. Kinsella was jailed for 20 months for perverting the course of justice in 2013 , after disposing of a meat cleaver used by a man who nearly severed the arm of a rival gang member.

Did the bike's real owner get it back?

Juries don't, judges can find out whatever they way. He copped a guilty plea so it would have gone straight to sentencing. Even his defence brief appears to have just shrugged and said "Yeah, what a plonker."

With that record and that offence, he got off lightly. It'll be 6 months served, so out September (unless he was remanded at the time in which case he's out in July) with a 3 year driving ban which he'll of course ignore, if he's even got a license.

Remember, you can get two years custody for having wheelie good fun.

They don't hear about prior convictions to prevent prejudice when deciding on a verdict 'guilty or not guilty'.
The previous is always considered when it comes to sentencing.
Otherwise our justice system just wouldn't work effectively. Shocked

I think custodial sentencing sends a good message that reckless illegal riding in pedestrian areas is not acceptable.

Not sure how I feel though, as though it's wrong I've done as much myself and ridden bikes when pissed and while I've had no insurance at times too.

Im not sure I'm liking the judgemental attitude of bcf or agree with it when you start looking at past crimes. You lot don't seem to need much previous to write someone off as a scumbag, and some people have the view that any previous at all writes off a person and makes it ok to call for punishment or death?

What about an upstanding helpful and well informed individual like say Rogerborg. If you discovered for arguments sake he sold cannabis to young kids on the quiet without implicating anyone else, would he instantly be just another low life scum, and that any helpful actions and help given to others is instantly null and void?

It's a narrow minded, bandwagon, better than thau world if so.
