Is the battery the same size?

Take everything apart, compare the battery sizes and put it back together again.

The battery box/space on an FZ1-N is very tight!
Are you absolutely certain that the new battery has gone in square?
Are you absolutely certain that you didn't leave a nut/bolt/spanner in the bottom of the battery box/space?
Are you absolutely certain that seat is correctly engaged with the tank/frame at the front and the latch at the back?

Ye checked everything no obstructions only used a Alan key the disconnect the battery so nothing left in the space. I've just replaced it with the same one but i just cant get the seat to lock back into position. the connection on both sides are to high to lock the seat in place. I've not done anything else other than take one out n put one inn.

Have you tried giving the seat a thump?
The seat on mine doesn't just drop into place, I have to give it a thump to get it to 'click' into place.
To remove the front seat, you have to take the rear seat off, has something that was under the rear seat been dislodged which is now blocking the front seat.
Also on mine there is a piece of heat shield material attached to the side of the battery, has this got wrinkled up stopping the battery dropping into place?
