Just been involved in an accident, going toward a mini roundabout following a mercedes, he did a u-turn on the roundabout without indicating, and I just went into the side of him. He then drove off and stopped about 100 yards up the road, got out walked to wards me, asked if I was ok, then told me that he was indicating.. (he didn't even have to be prompted, he just said it), then he got back in his car and drove off....
Now is that illegal on his part ? He didn't even wait around for me to get my bike off the road, he just vanished !
Got 2 witnesses saying it was his fault, and one of them got his registration before he drove off.
Just got back from the police station, reported it, hopefully I can get insurance to patch up the bike, where do I ly insurance wise? I have third party only, I'm not sure about him, he didn't stay around long enough to find out. It WAS his fault, I have witnesses saying that, so if he has insurance can I claim on his? I'm a little unsure.

Nasty
The driver clearly broke the law by leaving the scene of the accident, as you have reported it and you have a witness the
law is on your side. Even better for you because you got the registration of the car, now all you can do is wait for the police
to do their job. (if not you can make a complaint against the officer who you spoke to at the station)
In the meantime, get your bike checked out, get an estimate and speak to your insurance company, they will advise you on
getting your bike repaired.

So you 'straight lined' the roundabout? Lane disipline my instructor called it. (Or have I got the wrong end of the stick? )

OK, you've done right so far, now call your insurance and tell them you've been involved in an accident, I'm guessing you'll have to do this tomorrow. They should then send you some forms to fill out with details of what happened, the other vehicles registration and so on, they will then take it from there and try to get you compensation.
The driver did the same thing that the person who knocked me off did, expect to receive a letter from the police in a few months time infrorming you the driver went to court and lost his license. He will probably get done for failing to report an accident, leaving the scene of an accident and driving without due care and attention.
Good luck with everything and I hope you aren't hurt and everything sorts its self out.  |

He will get taken to court, however, that does not necessarily mean that he will lose his licence.
Failure to stop and failure to report damage/injury are taken as one offence by the courts and carry a penalty of 5-10 points and a possible fine (up to £1,000). Insurers really don't like people with this endorsement and his insurance will be jacked up for several years.
Driving without due care and attention carries a penalty of between 3-9 points.
So depending on how many points he currently has, and how many he is penalised, he may not actually get banned.
Sorry to disappoint.
However, if he is charged with driving without due care and attention, your insurance claim should be easier.

Thats nice to know, thanks for your reply.
It was a pure stroke of luck I got his plate, a kind woman took it down before he left, but she said she wasn't 100% sure. As mum was taking me down to the station I saw the same car drive past round another roundabout, with exactly the same plate, but a 3 was an 8, the police checked out the first and there was no sych car, but the second one I saw on the way down was !! Oh, and yes it was the same one
Can I get money for ripped jacket, jeans from the insurance? What about my helmet, although it only has slight marks, I hit the floor with it so can I claim for a new helmet, or is it just the bike i can claim for? ____________________ RooRoo: just like the time i stuck my finger up my arse with no lube at all and she didnt talk to me for hours |

Depends on your cover, and liability. If it's found in your favour, you should claim for everything that was damaged. They will usually try to palm you of with a couple of crap offers first, but unless you're desperate, refuse them. As for the lid, if it hit anything, no matter how gently, as far as bike claims are concerned it has done it's job, and can no longer be relied upon as protection. It should be replaced. ____________________ I was only doing what it said on my licence officer....

You had better hope that the other guy driving had insurance, it might be why he drove off.
Can I recommend a company called Rider Support who will pursue the claim for you.

Tintin, if the driver does not have insurance then Jammy-G still has a claim as it is covered by the Motor Insurance Bureau who pay out for untracable or uninsured drivers. They will go after the driver of the car to get whatever the insurance claim costs them back off him. |
