No refund !

I went to a well known motorcycle dealer in Hastings a few months ago to buy a Honda SP2, he agreed to a test drive.

The bike was ok, but had a high mileage for the year, we haggled a bit and agreed on a price, gave him a deposit of
£500 pounds on the Sunday morning.

Later that day one of my daughters rang me to say she had bashed her car and that could we help her out.

I said of course, oops just realised , I had spent some of her repair bill on a deposit, without further a do, I rang the dealer
and explained the situation and would it be possible for me to have a refund for now, he said, no can do.

Cross or what, I contacted my solicitor, she replied, you entered a legal contract by sighing your name to the receipt.

I had no idea, of such implications. So beware folks, even a verbal agreement can set you adrift. I have latter heard he has done
the same thing to others.

Any suggestions as how to treat this dick. Evil or Very Mad

I'm sorry mate, but once you place that deposit you are agreeing to buy the bike and entering into a legal contract to do so. For all you know the shop could of lost another sale on that bike as it was 'sold' to you. It's not the dealers fault that you have pulled out - why should they lose out?

That is surely the whole point of a deposit? It is you saying "Keep this bike for me and don't sell it to someone else, here is £500 to prove I am not buggering you about."

You buggered him about, he keeps the £500.

saying this i went a viewed a bike that i am buying very soon i put down a 200 pound deposit. I also told him before i gave him the money im waiting for my loan money to come through and the guy was nice enough to say yes. i told him it will be another 7- 10 days and he agreed to keep it. Very Happy

now just waiting on the loan money and vrum vrum zx7r Wink

Also yeah if i was you countryhare i would buy the bike maybe find another way of getting the cash for your daughters car?

I bought my bike.
None refundable deposit, 10% of the bike's value.
Had I decided not to buy, he would have kept the 130 and I would have been happy with that, because that's how it goes mate Smile

If you are putting down a deposit, put down the absolute MINIMUM you can.

I bought a £4.5K car last week, I held it with a £50 deposit.
