Cell phones or not, accidents will still happen. Unfortunately, there are no fender benders with motorcycles.
My heartfelt sympathy goes out to the victim's family over this tragedy, but please don't put all the blame for his death on the other driver or a cell phone. Unfortunately, I see this scenario all too often in my profession.

He does have a point.
Bikes are your choice, and dick heads are all around you, some twat will knock you off or kill you at some point, don’t kid yourself.

But then I’ll still ride, because I don’t care.

Edit:- let me just add, I didn’t chose to ignore that mobile phone comment, it’s just you aren’t going to stop people on the phone in a car/van/truck whatever.

Killa's right for once, the guy does have a point.

He's not saying "it's not the van driving mobile phone weilding dickhead's fault for killing you", but he is saying "If you choose to ride a motorcycle on the public roads with dickheads like this around in big white vans, there's a decent chance of you ending up dead! Part of the reason the biker died was because he was on a bike, and not in a car with more protection. However, that doesn't mean the van driver wasn't the cause of the accident."

I just emailed the paper, what a tosser.... this is what I sent

Dear Sirs

I was disgusted by the attitude shown by Dr. Rozzi in his recent letter. He seems to be implying that motorcyclist's deserve everything that happens to them, that it is OK to drive illegally and talk on a cell phone and knock someone down. Should bicycle riders and pedestrians also surround themselves with several tons of metal to avoid a similar fate?
Perhaps Dr Rozzi would like to have a truck hit his car and see how he likes being on the end of a similar collision, I imagine he drives some sort of expensive SUV. My thoughts go to the family; not only did they lose their child but they have to read boneheaded comments like these.

You may be interested to know that this letter has circulated around the world and I doubt many motorcyclists will ever want to visit South Bend if this is the attitude of one of it's local doctors.

What I would say is that the Doctor has probably dealt with death all too often….

Once is enough, but he deals with the reality of loss, and grief every week as his job.
All he is doing is pointing out meat heads in vans take no notice of public warnings about phones because they are complete morons.
At no point will the whole of the UK stop this mobile phone thing in vehicles.
No wonder doctors and nurses call us organ donors.

Well of course it's the victim's fault. How dare they ride a bike and not expect to be hit by someone with a bigger vehicle and more important things to do than look out for them.

Sorry but I disagree - I am a motorcyclist and if I go out with out full protective clothing (occasionally) I accept that if someone knocks me off and I graze/brake that unprotected area, there is an element of responsibility for me not taking full precaution.

He was just stating the reality of what happens and that if you dont wear full protection it could make the difference between life and death even though the initial accident may not be your fault.

If that was what he said, I'd be inclined to agree.

What protective gear do you wear? Mine is just leather and plastic/foam!

The headline of the newspaper is just silly, but nothing that isn't expected from a newspaper trying to grab attention.
He uses it as a bad example of the 'blame culture' he seems to be pointing the finger at.
What he does wrong is suggest that this was the attitude of the dead rider, or any other riders.
He mentions 'common sense and personal responsibility' should be a priority. I think that is more of a priority among bikers than anyone.
I accept the consequences of riding a bike and I'm fully aware of that I would be better protected in a car. Most riders are educated enough to not rely on the rules of the road to protect them now and take responsibility for thier own safety which is always at risk. We all know to 'trust no one'.
If he's simply saying that we're mad for not being better protected then he might have a fair point.

He should find an article about someone sueing for damages for burning themselves with a cup of coffee in mcdonalds to make his point.
He shouldn't be assuming the dead rider wrote the headline.

Hi

Can see where he is coming from, and to an extent agree.

We know the extra risk we take by riding a bike. It is our choice. Complain about the results of that choice too much and someone will force their choice on us instead. After all, if we want totally safe transport then a motorcycle is one of the last options you would select (along with riding a horse).

Hi

So how does choosing not to take the best possible safety precautions mean that you are in no way responsible for the outcome?

If the helmetless rider had been standing on the seat arms out straight and so failed to take any action to avoid a vehicle straying onto their side of the road then I am sure most people would say that they contributed to the results of someone elses mistake.

I am not saying we should all go an buy a Volvo, just that we have to accept that there is a level of risk in life, and our choices affect that. The alternative is that someone else is responsible for the effects of your choice, and so will make that choice for you.

It's a facile argument. If the biker had been in a Sherman tank then according to you and Dr. Dicksplash it would be the van driver's responsibility be in an Abrams.

The burden of responsibility is on the offender, not the victim.

So the victims choices contribute to the results. Either accept that and the responsiblity for that, or accept that some one will remove your choice to increase your own level of risk.

You cannot have your cake and eat it.

Or maybe the next time you cut yourself shaving you will sue the maker of the razor.

Bazza first off mate, we can see this guy is obviously not a biker.
He wouldn’t have used the words ‘common sense’ in a negative way nor claimed we are stupid for not driving a Volvo.

This guy isn’t sticking up for anyone, nor is he slating men and women for riding bikes, he was just saying, a man in a van was on a phone and caused the accident for being a dick. But because the biker wasn’t wearing the Iron man suit, he died.
I must admit that this bloke is a little hasty on claiming it is due to lack of common sense but at the end of the day he is stating the obvious, which is accidents happen, you might as well do your best to protect yourself.

I’m not reading his letter and thinking “Oh shit yeah, good point”

I agree - I can't see how someone can disagree with this. Obviously sheet metal is a bit on the extreme side but at least leather and armour can make a massive difference when rolling down the road.

If a van driver knocked a rider off at 70 and the rider slid down the road in their leathers without injury, the van driver could be 100% at fault. If they knocked someone on a motorbike off in jeans and a jumper at 70 and the biker subsequenlty died of road rash and broken bones, the severety of the wounds would be a shared responsibility between the van driver and biker.

If the van driver had not been at fault in the first place, the accident would never have happened and hence no injury. The doc's point was that accidents happen, and bikers can affect the outcome even if it isn't their fault.

I refer back to my first post in this thread. If you're going to argue that this Doctor's "common sense" approach to life is acceptable, then you subcribe to the view that - no matter what - it's always the victim's fault for what happens to them, simply because they didn't take the "common sense" precautions to avoid being a victim.

So, based on the Doctor's view, any biker would have a solid, legal "self-defence" justification for shooting dead any phone-using van drivers he sees simply because it is reasonable to assume that he would be preventing a fatal collision.

Now you're talking. I'll vote for any party with that in their manifesto.

As I said, he’s not a biker, so pretty much saying what he thinks, i would imagine he thinks mopeds are as dangerous.

He’s just stating the obvious, Van VS Bike, van wins every time regardless of the phone.

You seem to be suggesting that fault lies with a single party. I would say it rarely does, and many peoples actions will affect an accident and the outcome of an accident. Riding a bike rather than being in a car might well help to cause the accident, just as it might well help to cause the "accident" not to happen. In the same way that riding a bike and choice of gear affects the outcome (for example the rider who looses control and lands in a field when a large car in the same situation wraps itself around a lamp post before getting to the field).

And I would say that the responsibility also lies with a number of people, although picking a scapegoat does make things easier for those who want to regard themselves as the victim.
