If your solicitor hasn't even managed to get the details of the other person that was involved in the accident from the police in 3 months, I really think you ought to consider getting a new solicitor!
White Dalton seem to get good press.
| Quote: | Changing solicitors
Some questions to ask;
1. Did you choose them or were they appointed for you?
2. If they were appointed you can change. This is your right.
3. If you chose them, what is it that you are unhappy about?
Is your solicitor never available to talk to you? Never returns your calls? Have you been given the name of someone to complain to? If you haven’t, this is a breach of the Law Society’s Code of Conduct for Solicitors. You could ask to speak to the senior partner or complain directly to the Law Society - Tel: 020 7242 1222. A common complaint is that the solicitor does not respond to letters or phone calls. But how often do you write/phone? If it is more than once a week, it’s too much. Your solicitor is probably waiting for a reply to his letter to the other driver’s insurer - and they can take weeks to reply! If you have had no contact for a month that’s different and you might be right to be dissatisfied.
Things to consider when choosing a solicitor:How much experience do they have of personal injury work and bike accidents?
Do they specialise in this type of work or do all sorts of work?
Will a qualified lawyer (solicitor or barrister) be dealing with your case?
Will you be able to speak to your solicitor when you need to or only to their secretary/assistant?
Does your solicitor ride a bike?
At White Dalton we specialise in bike accidents. You will have a qualified lawyer handling your case who rides a bike. If we are not available and you leave a message, we will phone you as soon as we can.
Want to change? Here’s what to do:
1. Contact us:
Freephone 0800 783 6191
2. Tell your present solicitors that you no longer want them to act for you.
3. What if they say I can’t move?
You have the absolute right to choose who YOU want.
4. Will it affect my case?
No, it shouldn’t. However, depending on how far your case has progressed or how near to limitation your claim is, it may affect your decsion to move.
5. What about costs?
Q. Have they done any work?
A. No - they cannot charge you anything.
A. Yes -
6. Once you have told your present solicitors you don’t want them any more and signed a General Release Form for your new solicitors to get your file from the old solicitors, you should be able to leave everything to the new solicitors. They should be able to advise you on costs, Conditional Fee Agreements and legal expenses insurance. They should also contact the other driver’s insurer.
REMEMBER:
If you want to change your solicitor the sooner after your accident you do so the better. We cannot undo an agreement to split liability or to accept a certain sum of money in compensation. At that stage it is too late. If investigative work needs to be done it’s best to do it before the witnesses have forgotten what they saw. If in doubt,
