Just got a letter through the door fining me £100 for not filling my 2005-2006 Self Assessment in.

This would be fine if

a) They sent me the right documents that I had repeatedly asked for
b) If I was supposed to Self Assess that year anyway.

I was trying to claim back money for the past 2/3 years... And I recieved a trust payment in this period (2006-2007) So i was told I'd have to SA for this year.

Dozy cronk opened a file for 2004-2005-2006, so I am being fined on Self Assessments I don't even NEED to do.

Phoned up a couple of weeks back asking why the fuck I have to do it.

They said "File's been opened now, you'll have to do it"

So now I have to track down all the jobs I did in that year and fill out all the paperwork, when I work pretty much all day.

Anyone got experience of appealing against tax office fines? Know what chances I stand?

Thanks,

T

Find out where your records are , then firebomb the place.

At least if you still have to pay, you will have caused them more than £100 worth of damage

Sounds like a crap situation, and one in which I have little or no experience. If you can put together a clear timeline of events, showing where you have attempted to comply with their unreasonable requests, and where they have muffed up, you should be fine. If you get no joy with the monkey running your file, just go up a few levels and write directly to the head honcho at your tax office.

I've had a similar situation, since the C&E and Inland Revenue merged sometime last(?) year I got sent SA forms to complete from 2001 onwards, then fined because I hadn't completed them during the relevant years (when they hadn't sent me forms)...I got the same answer - they're opened now you have to pay/complete them...

Trouble is, the new C&E/Inland Revenue monster has some draconian powers these day too Sad

Good luck mate

A.

yes I do , its part of my 9-5 job , you generally have to appeal to their better nature and give examples of your exemplary behaviour as regards to tax returns,

when phoning in phone your tax office , and if a woman answers say wrong number , and put down the phone,

if a man answers ask him nicely , in the office asking women to repeal fines has a 2% chance of sucess (out of the ones that get fines , ie 2-300 ,) , asking men at the tax office however gets a 85% sucess rate,

why? , men who work for the tax office are more laid back and easier going , while women do their jobs properly.

Also you might need to provide evidence , ie when you first took any payments of trust income , as this can be an indicator or when you had to fill in a tax return (you only need to do a tax return if your investment/self employment income breaches 10k and some folks at the office keep their investment income @ £9998.00) or if the tax office hates you.

illness and incapacity are also good excuses , this bloke who was dead received a £100 fine , and this woman at the IR refused to repeal it period , I called back later and a bloke said oh , cancelled it and released a 07/08 coded underpayment for me too.

If your income is below this level and you have bank statements to prove this ie it going into your account (ie if it went in say April 4th 2006 , and it was 10K+ , you have to do a tax return for 05/06) , but shuffle it a couple days later say April 7th , and it goes to 06/07.

Bank statements as said are verra handy for this, And aslo the accounts of the trust you are reciving income for, if the trust didn't give you a dime for those past years = no tax return, if they did then maybe,

but remember the IR is a tool of the government and NEVER EVER admits responsibility , and there are ways to get money back, however I'd lose my job if I told you.

Also NEVER ever piss off the revenue , they might hit you back via putting an enquiry on you , which if you are legit theres nothing to fear (this is not a fascimilie of the lie of nothing to hide nothing to fear since that statement is a lie as political opponents are smeared and attacked by such laws , ie Walter Wolfgang , or Pam Warren) .

However the process of having to hire lawyers and accountants to make such representations , costs a fair packet, which is NOT a tax deducatable unless you own your own biz.

Hope this helps,

ride to Mancs if you want a hand.

I had one of those plus a demand for £6000 of tax that I owed. I also had interest added at about £2 per day.

I couldn't be arsed to go through the paperwork and sort it out.

Finally managed to do both my 2004-05 and 2005-06

Received a cheque today as I had overpaid - woohoo!

Didn't pay any fines or anything Thumbs Up Very Happy

Hi Itchy,

Cheers for that, most helpful.

I dont have any investments and I'm not self employed.

Only had the one trust payment and I have a form with the details of that on.

Will phone up a bloke and ask nicely as you said.

Cheers,

T
