Just been sacked from my job Sad


Been working there for almost 3 months as a electrical mechanical engineer on shifts carrying out repairs and break downs to pasta production machines, but according to the clueless cunt of a engineering manger who knows nothing about engineering l,ve been showing no intrested in the job even though l,ve always stayed late to finish a job and have done overtime when asked Rolling Eyes

But l think l was sacked becasue l refused to become a shift hoilday floater (coving those on hoildays shifts) which was,nt in my contract and that l complained about the illegal wiring of the machinery "not up to IEE 16th edition regs" (PVC 400v three phase cables supplying machines running across the floor with no mechanical protection, faulty isolators, damaged glands, exposed 240/400v wiring etc).


Got escorted off the site with all my tools and things 15 min after been told to go,

Sorry to hear it...not much you can do as it sounds like they got rid of you in the probationary period. You could always get 'revenge' by reporting their dodgy wiring to the HSE, or whichever authority covers those things....but get a decent reference first! Wink

Think you need to seek legal advice mate.

Might be tough only being there for a short time. But H&S might be interested in the state of the equipment!

Shit news, best get yourself down to the agencies to find some temp work to tide you over.

I was still inside the 12 weeks probation period so they could sack me for any reason, going to report the HSE and infestion issues does any one know who to contact over this?

Contact the HSE directly I assume, they will be able to inform you if it is a local matter and pass you on to the correct people.

Not a thing you can do legal wise on your job. You were inside the probationary period, however, you could get them on procedure possibly, ie did they pay you any notice/give you any notice of at least a week?

They obviously like short cutting things and saw you as a threat....!!!

Email should do it, dont mention that you are a disgruntled ex employee tho, they get it all the time!!

Refs - dont worry bout that, they can refuse one, or give just dates and job title, most companies do this anyway now due to not wanting to take the rap for recommending a crap employee!!

You were probably fired for this. I would look at the 'whistleblower' laws as you may well be covered regardless of time worked.

Funny you should mention that, because i thought that too, until a couple of weeks ago when i heard one of the directors of the place where i work giving a very bad verbal reference along the lines of " hes a bad worker, if he can even be bothered turing in "......
I was pretty shocked, i mean if they have already sacked him then why bother about where he goes next, he wasnt such a bad lad.

I would imagine you can't give a bad reference, but I can't see anything stopping an employer telling someone why the person left them.

Had that one fairly recently with a member of staff who had been sacked for stealing money from the till. Her next employer (a residentiual care home!) called to ask why she left her employment with us. The boss told her straight up that she had been sacked for gross misconduct after catching her with her fingers in the till.
Needless to say, she did not remain in her new position for very much longer.

Thats fair enough, but the guy at work was just a typical young lad and had turned up late on Mondays etc.. I thought that seeing as he was probably going from one minimum wage job to another, they didnt really have to mention it.
The director takes home his enourmous salary every month, so why be such a shit to someone at the bottom ?
Stealing, starting fights, burning the building down, then fair enough.

report them to the HSE , but don't tag your name on it , your name will be black listed forever in that
industry,

you should have kept your mouth shut for 6 months , done the job and THEN left , tagging an anon
complaint in to the HSE, = experience + you don't ruin your career.

lots of people here say sue them or something , but this isn't a good idea in principle its good in reality v bad , people here will egg you on as its not THEIR career at risk here You think you are gonna get enough compo for the rest of your life?

I remember a chat from somewhere which I heard from the radio or something where a worker wanted to blow the whistle on
some very dodgy practices , the union rep/lawyer said "you do have arrangements in another industry don't you? , since the guys at the top even as enemies and rivals will go talk off the record about their employees past and present. The old watch out for this guy

I cover my own ass at work by printing out emails of what bosses order me to do and keeping ALL correspondence, and nothing can be pinned on me other than the mistake I openly admitted to about 3 months back.

i know a trainee solicitor at birminghams top law firm. she got a first in law(good grade), and is currently working in their employment law department.

i emailed her tatters's first post, and she said this

"he can claim wrongful dismissal and claim back one weeks salary or whatever notice period is provided for in his contract.

he cannot claim unfair dismissal as he has been employed less than one year UNLESS he can show the reason he was sacked was for Health and Safety reasons, but I would need to really investigate this, and it would need me asking him lots of questions.

advise him to go to citizens advice bureau or if he is in Birmingham to contact college of law in birmingham as they do a free legal advice thing called BERAL, Birmingham Employment Rights Advice Line

Not got too much time this morning but will have a better read up later on."
