does anyone declare (if have any) convictions for driving offences when applying for motorcycle insurance?

i have a CD10 (undue care and attention + 3 pts) and im thinking of not declaring it as my insurance premium went up by £200.

should i declare the offence? my uncle has a few convictions and he has never declared them and hasnt been found out, im just wondering if anyone does acctually declare offences and how would i be found out if i didnt declare the offence. cheers for your info/replys Thumbs Up Thumbs Up

I would!

Personally wouldn't give an insurance company an excuse not to pay out if involved in a major "incident".

Your choice, but bear in mind that you're technically uninsured, as your insurance is null and void if you haven't declared everything to the company.

If you get found out, you're then possibly looking at another conviction for no insurance (among other things). Thumbs Down

3 POINTS dont tend to make too much differecnce. I declaired my points.

But I never declair criminal convictions as they can then refuse insurance and I dont think they are allowed access to the CRB.

Not sure I think its just Assult and Crim damage (Although the assult was selfdefence still was done) that was 7 years ago almost.

Im not sure If the keeping a untaxed car on the rd counts as one or not!

Convictions such as assault and criminal damage are a different kettle of fish altogether, for one thing they are not on your driving licence, that your insurance company can request to see: CD10 would be. They can ask you if you have any criminal convictions, but depending on the sentence you received and length of time passed, you may not have to declare them Rehabilitation of Offenders Act

As has been mentioned, if you do not declare them then come a cropper, you will be in a boat without a paddle.

And no Stu, tax does not count!

declare them, if moneys tight then moneys tight but shit happens im afraid, do the crime do the time an all that, if you dont declare them then you will be uninsured, when you crash it will put up all the honest insured drivers/riders out there.

its 200 quid? if you cant afford to pay it then get something you can insure cheeper, the first car i had was 75 quid, because i couldnt afford to pay for a decent cars insurance at the time,

sorry, but i hate it when people try to get away with things when im paying full wack on my bike and car

not to play top em, im 19 and i pay 1500 for my car tpft and 350 for my bike, its not on the road now tho so its not insured but my car is modified so this is where it pisses me off, i have to pay more on my premium for modifications because im more of a risk, fair play, but the other 50% is to pay for the uninsured tools who think there above everyone else.

btw, this is you befdelta7.

Convictions, motoring or criminal are the first thing we go for when we feel a claim should be rejected so i would declare them if i was you.

If you get stopped by the police and given a producer they will often ring the insurance company to check the details, if convictions on your license dont match those on your policy you could find yourself in a fair bit of bother. If you're in a an accident without declared convictions on your insurance then you are f00ked, you wont get anything other than another conviction (IN10 - driving without insurance as yours will be void) and maybe even worse dependant on circumstances.

Criminal convictions im not sure about, we can ignore serious driving convictions once over 5 years old, criminal convictions regardless of age or severity do not expire and are an instant decline for my company.

I have never seen a claim involving an undeclared criminal conviction but i would assume we would get the big boys in to get any claim thrown out if it was to happen and i assure you no solicitor will get you out of that one without the use of said Rehabilitation of Offenders Act. Even so you will note that "an ex-offender is not normally obliged to mention their conviction when applying for a job or obtaining insurance" suggests that you dont have to mention it but if you are asked then you do have to mention it and as far as i know its been a default question on insurance quotations for a long long time.

Rehabilitation of offenders act as posted previously, five years for a criminal offence. You dont have to provide details of an offence older than 5 years whether going for a job or getting insurance. If the insurance company wont pay out because of a ten year old or even a 6 year old criminal conviction, there is something seriously wrong. Do the laws of the land not apply to insurance companies? I know im not going to admit to an offence over five years old legally i dont have to.

Tell the truth or have no insurance!
That's basically what the score is & trust me you don't want an IN10 on your licence. The insurance companies take a very dim view of that one when it comes to next years policy!

This is almost true but its a sliding scale depending on the offence, more serious offences have to be declared for longer.

Insurance works on the principle of "utmost good faith".

If you provide information in bad faith - i.e. lie - then the insurance company is quite within its rights to declare your insurance null and void.

The reason they ask about other, non-traffic offences is to see if you've ever been prosecuted for fraud, dishonesty or other similar offences which may increase your risk to the insurance company.

An example of fraud might be claiming that something's been stolen when it hasn't - which I understand is a common problem in the mobile phone insurance industry.

Lies don't have legs, and you'll trip up sooner or later. Telling the truth is much easier, and less likely to land you in serious hot water.

£200 quid isn't that much when all is said and done.

If you can't afford £200 then you either shouldnt' have got done for the due care, or shouldn't have a bike. Simple as IMO.

Think yourself lucky it wasn't £1000

Having re-read your post, I think your points are probably for driving without due care and attention.

You don't usually get given points for driving extra carefully.

Don't misinterpret the Rehabilitation of Offenders Act: The 'spent' period is not based on the offence, but on the sentence. If the conviction is spent, you are under no obligation to declare it when asked, except for certain types of job where a CRB check is carried out anyway (usually).

The Act states that you aren't obliged to mention it, if you are specifically asked and dont mention it then you are going to need a good defense in court should the worst happen.

Why would a crim conviction stop you from getting insurance Ive never understood!

If you were a major crim anyway you wouldnt even bother getting insurance in the 1st place!

I was done for something I never even really commited so why should I be refused insurance for one minor issue 6-7 years ago!

Come on Siggi Views? What do you tell your insurance?

I pay £400 fully comp on the R1 thats protected with 1 non fault claim and a clean licence.

It won't necessarily stop you getting insured, but may have a bearing on how the policy is loaded. Convictions are evidence of patterns of behaviour. In risk assessment terms (which is what insurers do) past behaviour is the best indicator of future behaviour.
