After my new exhaust managed to burn down the pillion seat and everything surrounding it, I realised that it has gonne free from the connecting clamp. Now with the estimated damage of around 2.2K Shocked , am fighting with my dealer to get it sorted! Boy, the can was LOUD!!!! Laughing

Dear Rob,

Repair of Damage to Kawasaki Ninja xx06 NJY: Faulty Fitting of Upgrade Pack

Further to our telephone conversation of 18 December 2006, I would like to clarify the sequence of events and actions to be taken:

1. I delivered the above motor-cycle to your dealership on 09 December 2006 for the upgrade pack to be fitted;
2. I collected the motor-cycle on 09 December 2006 evening and immediately noticed a different noise coming from the can;
3. On 15 December 2006, I noticed that the rear tyre was punctured and there were melted plastics hanging loose;
4. This was caused by the exhaust-can being detached from the link pipe which melted the pillion, underseat (including the scotoiler), indicator mounting, tail fairing/lights, alarm and surrounding plastics through release of hot-air;
5. On 18 December 2006, you suggested that this was not caused by incorrect fitting of the upgrade pack but by someone attempting to steal the exhaust; I was specifically advised that the screw on the clamp of connecting pipe were not loose.
6. I did not accept this explanation because:
a. If the can is fitted properly to the link pipe, it shouldn’t be possible to detach the same without unscrewing the clamp.
b. My bike is kept under cover at my place. At no time, I found the cover removed from the bike. Probability of someone uncovering the bike, trying to steal the can and then putting back the cover is very small.
7. I requested that the above be repaired for no charge and you said that you would provide a proforma invoice.
8. Further to your subsequent call of 19 December 2006, informing me that the estimate of repair is GBP 2,217.00 and suggesting that I bear a proportion of this cost; I maintained that I should not be responsible for the cost of repair.


I look forward to the quick repair of my motor-cycle at no charge to mitigate the losses currently incurred due to the alternative work-transport arrangements I have put in place.

The letter looks like a good 'un, I can't believe that this happened so soon after all the aggravation you had getting the kit installed in the first place.

Unbelievable they are trying to blame it on an attempted theft! But by saying this, "I look forward to the quick repair of my motor-cycle at no charge to mitigate the losses currently incurred due to the alternative work-transport arrangements I have put in place" Are you not implying you accepts some responsibility?

I would have just said I accept no responsibility and that it is now costing you money, as it is unusable, that would be claimed back from them.

Yeah, it was written with the help of a collegue , who is an ex-solicitor Thumbs Up Had to do lot of tweaking to my original letter, so as to ensure it's proper! Laughing

The letter looks good, nice and subtle so far. If you need to reply to a subsequent letter a response including something along the lines of; you currently feel no need to get Trading Standards and the courts involved as you are hopeful an amicable resolution can be reached, blah, blah, blah. Remind them that you aren't backing down and are willing to go all the way this this.

At the end of the day it will cost you about £120 quid to file a MoneyClaim against them and it's reclaimable if you win. You can also add any costs incurred and interest. It's will cost them a hell of a lot more to defend this if they decide to in the Small Claims Court. I had a problem with a dealer and an engine. Trading Standards stance was that as they were the last people to do any work on the bike, then it was reasonable to presume they caused the problem.

Any bike owner is good enough to work on their own bike IMO.

If I can learn it (and I never used to be great at the whole 'manual dexterity' thing when I was a kid) then anyone can.

That said, I do know a dealer I trust that can do the work if I can afford it and don't have time to do it myself.

There are no other dealers that I trust... especially judging by this kind of horror story!!

So the new exhaust was part of the upgrade or was it already there?

Would be dodgy to think of it melting through your scottoiler and pissing the lube all over your back tyre, I think the letter may have had a larger figure in it if that had happened!

In Colin Collins defence, they are naturally going to say it wasn't them because I'm sure they would like to think their mechanics wouldn't be stupid enough to forget something that vital!

Everyone slips up...even mechanics. Hope they pay the price and you get it fixed!

It's stories like this that should make you do your OWN mechanics! Don't wait until it happens to you. I certainly wouldn't be happy trusting anyone to touch my bike without triple checking myself.

I use Colin Collins in Letchworth for test rides of bikes i'm thinking of buying privately.
Frankly they even managed to fuck that up on the last 2 occasions by having fuck all petrol in the bikes and leaving me sitting at the side of the road.
Having said all that, they are marginally better than my other local dealer which is Motorcycles and Moore - the last time i tested one of their bikes it didn't run out of petrol - it broke down first!!

This is the reason I do all work myself. You pay someone you dont know to do the work, they rush it cause they are under pressure to get bikes in and out to max their profit, and they do a bad job.

Its a shame, as usually the mechanics are pretty decent guys, its just the owners pushing them to turn round loads of bikes so they can make more money.

I hope you get it sorted quickly and without too much hastle.

And Dew, if you ever need anything like this doing in future, give me a shout, I dont rush the work I do, and it gets done properly! Wink Thumbs Up

I know ive been there and thought they were crapwits.

Oh and yeh colin collins letchworth are shiesters, but only the garage side of it. Ask strag his opinion of them lol.

Tried to charge him to helicoil out a tapped bolt or something.
