Need some advice,
We are pretty much going to get evicted, I am looking after a dog for a friend who has lost his business and house. He has nowhere for the dog to go so we are looking after him for the time being.
It is against our contract to have dogs in the premises, our landlord even had a go at us for having a hamster, the neighbours upstairs are fucking idiots, they are that bad that when ever im in the gaden they have nothing better to do than stand at the window watching me for an hour at a time, even two hours yesterday.
My mum visited us from dorset yesterday and bought her dog with her, we tried introducing the dogs to see if they got on, they didnt so we put the dog im looking after back in the house. The neighbours have complained to the landlord that we have a dog. They have also said that yesterday we were mating the dogs in the garden.
Now the landlord came round today and we were having a heated conversation, the neighbours came out and stuck thier two pence in, stating we were mating the dogs yesterday. When I pointed out that they were talking bollocks as both dogs are fucking MALE, they decided to change their story. They are now saying we were promoting dog fighting and getting the dogs to fight. Again absolute tosh, my mums dog is soft as edam and we were trying to see if they would get on.
The whole thing got bigger until it ended with me telling the neighbours to fuck off and stop talking shit, then me and landlord started and that ended with me telling him I was gonna whack him.
He say's if the dog doesn't go we are getting evicted, I said well fucking evict us then. We are looking for a housing association and an eviction notice would help.
I also said that the dog is going nowhere till my mate has something sorted as I aint seeing it go to the dogs home.
His argument was that plenty of dogs live in kennels, so I said oh well thats fine then, plenty of people are murderers lets all go out stabbing.
He says under section twenty one of the housing act he only has to give 1 months notice, when I am pretty sure its two months.
Does any one know the script?
I have tried searching but cant find any info.
Cheers
Andy |

Depends on the type of agreement you have...but here's some infor which may be useful.
I have just received an eviction notice - what should I do?
First of all, don't panic. No one is going to make you leave your home straight away - by law you have to be given two months' notice and after this period a court order must be obtained. You have rights to appeal if you do not think your landlord has reason to apply for your eviction (see below). However, you do need to take action as soon as possible. Visit your local CAB (details are provided on www.nacab.org.uk) or contact National Debt Line on 0808 808 4000.
What is an assured shorthold tenancy - does this give me any other rights?
Since February 1997, all new private sector tenancies are assumed to be assured shorthold tenancies unless the agreement states otherwise or the landlord gives written notice that it is not.
A letting cannot be an assured or shorthold tenancy if:
* the tenancy began before 15 January, 1989;
* it is a company or holiday let;
* no rent, a very low rent or a very high rent is charged;
* the landlord lives at or shares the premises.
There are also some exceptions for former public sector rented accommodation being transferred to the private sector and where a long lease comes to an end.
Assured shorthold tenancies - the facts
Under new legislation, there is no longer a requirement for the tenancy to be for at least six months.
However, a court cannot grant an order of possession during the first six months of the tenancy except in limited circumstances; the most common of these are:
* rent arrears of at least eight weeks
* death of the tenant
* mortgagee exercising power of sale
* demolition or reconstruction of the property
* tenant has breached the terms of the agreement
* tenant or other person in occupation has allowed the property to fall into disrepair
After six months the landlord can apply to the court for possession, as long as the tenant has been given two months' notice.
When the original tenancy agreement comes to an end, the tenancy can either be terminated or the landlord can choose to let the tenancy continue as a Statutory Periodic Tenancy. The terms and conditions of the original tenancy still apply and the landlord can terminate the tenancy by giving two months' notice at any time in the future.
If the landlord does not renew the agreement, the tenant can stay on until the landlord gives notice that he or she wants to repossess the property. ____________________ SV650 - TRASHED

I don't want to revel in constantly sniping at you Guv, but if you knew that your letting agreement banned dogs, why did you take in the Staff?
If you've breached your contract, your landlord is quite entitled to boot you out, having attended in person and asked you to comply with the rules. That said, sounds like he is trying to pull a fast one with the notice period.
I would suggest that you get down the to Citizens Advice Bureau as soon as possible, and get some help - as I'm sure you've already worked out, you need to get this right first time, and asking all us nasty gits on here is going to lead to a lot of confusing and inaccurate assistance! ____________________ >Soultrader Mister James, I bet you are a copper

Weither he does is another thing. I have been through this before and was told because i broke the lease (which i didnt i had prove) i was out.
See what happens, only thing is when your looking for a place they want deposits and a month in advance up front and thats alot of money especially when your trying to save for a baby. That may help when your looking a new place though, they like to see couples who are having kids coming. For some reason they think you wont wreak the place ____________________ All the breast.

Can a landlord evict someone who is on a 'tagging system' restricted to a specific address?
On a serious note, if you ARE still on a tag, it may be a good idea to contact your probation officer immediately. ____________________ Funny, I used to hate being spanked as a child!
