 |
|
I'd just come off a national speed limit road and onto a 30 road, which is a long sweeper with fields on either side and a bus lane, and I didn't slow to 30... I was rolling along at about 58.
Won't do me any good but absolutely everybody does at least 45 along this road, it's practically a dual carriageway.
Anyhow, a traffic cop overtook two bikes that were behind me (who presumeably slowed down) and I mistook his headlights for them tailgating me...
Because it was 60 in a 30 zone it's not a fixed penalty and apparently I'll get a summons Probably a £100 fine and 4 points or something?
Was here (Google map): https://tinyurl.com/yrt33f
First time I've had points, ought to blow the insurance.

Found this ...
https://www.drivingban.co.uk/drivingban/speedingoffences/drivingbanspeedingoffences.htm
Generally speaking, the higher the speed, the greater the risk of an instant ban and as a general rule of thumb, when the speeding offence is in excess of 40% of the speed limit, there is a risk of an instant driving ban:
30 mph In excess of 51 mph
40 mph In excess of 66 mph
50 mph In excess of 75 mph
60 mph In excess of 85 mph
70 mph In excess of 100 mph
all taken from the site, of course every case is different. |

Should've turned yer idle speed down
Then you would've been able to brake from 60 to 30 much faster

The traffic copper advised that 3-4 points and £100 is most likely. He said a ban was theoretically possible but unlikely.
Bloody annoying anyway It's practically a honey trap that road. ____________________ Yamaha SZR660 Caution to the wind, the throttle pinned! |

They only tend to slap you with a ban if it was WAAAAY over the speed limit , or more importantly, if you were riding / driving dangerously.
That pedal by your right foot, of the lever by your right hand tends to slow you down a bit faster too. ____________________ ---------------------------------------------------------------------------------------------------------------------------------------------

Obviouslly enough the idle speed had nothing to do with the 50-odd mph i was doing, but I do see the irony yes ____________________ Yamaha SZR660 Caution to the wind, the throttle pinned! |

I think you'll get away with a decent haul of points and a fine. By decent haul I mean 4-6 points. I think you'll escape a ban to be honest. ____________________ Yamaha YZF-R6 |

What exactly does a summons mean? Do I actually have to go to court? Seems a bit much, the traf copper was dead calm and didn't even give me a bollocking, almost didn't care. Only after did I wonder if a "summons" meant actually going to court... ____________________ Yamaha SZR660 Caution to the wind, the throttle pinned! |

Yes it means summons to court, ie your case will be heard before the magistrate/judge. You were too far over the limit for you to be given a fixed penalty notice, hence the need for your 'own' hearing because they could technically ban you if they wanted for that speed. ____________________ Yamaha YZF-R6 |

A quick look on the website shows that if I dont plan to contest my speed (which would seem pointless) that I can just plead guilty and write a mitigating letter and it will be dealt with in my absence.
I'll write a letter explaining the width of the road, and the fact that there are no buildings on either side of the road, and hope for the best.
This road is literally a dual carriageway with a 30 limit on it. I feel ridiculous going at 30 on it, like people are going to beep at me. It's 3 lanes wide with fields on both sides, and about a mile long... Total honey trap. ____________________ Yamaha SZR660 Caution to the wind, the throttle pinned! |

You do that, they love people whining about how its not their fault. There are no mitigating circumstances, just excuses, and that is exactally how they will read your letter.
| loply wrote: | This road is literally a dual carriageway with a 30 limit on it. |
In your opinion, which therefore justifies nearly 60 does it? Its a signed 30mph road within a few hundred feet of houses.
| loply wrote: | I feel ridiculous going at 30 on it, like people are going to beep at me. |
So let them get the fines and points, and all the hassle that goes with it. Pity the guys on bikes behind you didn't decide to beep you.

Different opinion if you zoom out a bit. |

Good luck.
I had to go to court with a mate (so I could drive him home), exactly
same speed 58 in a 30.
It was a dual carriageway.
He got a good solicitor, but she made him aware that a ban was a strong possibility. In the end he got 6 points and a fine.
I can't remember the fine, but the money isn't the issue.
Good luck.
I would recommend going to court though and not just doing it via
letter.
Your decision.

I'm pretty certain they won't even consider a ban, on account of the fact the copper said so.
Obviouslly he's the best guy to ask and he reckoned 3-4 points and a £100 fine was most likely, so all the armchair lawyers predicting a ban need to hone their skills a bit.
I'll let you know how it pans out though.
Ichy, the bit near the houses is not where I was speeding. It was the bit with the fields on each side. ____________________ Yamaha SZR660 Caution to the wind, the throttle pinned! |

He didn't show me proof of speed or even mention that he'd used that speed tracking thing, but I know I was doing over 50 so I don't plan to contest that.
I'll just explain about the misleading road and hope for the best
