ok, set the scene...
At the front of the gym i work at there are some of those black metal "posts" that are ment for tying your pushbike up to. Inbetween is a rather large gap where people tend to park their motorbikes so they are in full view through the window. All is fine until one day a traffic warden comes along and starts giving these bikes tickets. He was saying that as it is classed at the pavement, these bikes are parked illegally. Load of shite really.
So anyway, a bloke was saying that you can put a plastic bag around your numberplate and they cannot give you a ticket at all? A few bikes have started to do this and i have seen some traffic wankers walk past without batting an eyelid.
Can i do this legally? can i effectely remove my plate from the bike so the traffic bastards cant give me a ticket? Also, if my road tax is on show, can they just give a ticket using the information from that?

Are you sure the posts are not there to attempt to stop ram raiders... Is there a sign to say cycle parking?
In many place it is not legal to park a M/Bike in cycle bays, York is certainly one place where you will get a ticket for doing so. ____________________ Just because my bike was A DIVVY, does not mean i am...... |

It is quite legal for anyone with designated authority (Police, Traffic Warden, parking Attendant) to take reasonable steps to secure the identity (registration number) of any vehicle believed to be commiting an offence, and this would include removing a plastic bag covering up the registration plate.
If you remove the plate from your bike, then you risk further problems, not least of which is that of attempting to pervert the course of justice which is a criminal offence, and this would resultn in the Police being involved rather than the local warden.
As far as the parking is concerned, then you could have been done for driving elsewhere than on a road, obstruction or under a local bylaw (so clarification is required to determine exactly what offence you have been done for) but if it is in contravention of a specific parking offence, then the lines, signs and traffic order must all be in place and correct. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |

My local Traffic warden told methat if you park on a double yellow line, they MUST give you 10 minutes before any ticket is issued (Which is why in a lot of cases, they appear to wait until you are on your way back!) however, if the vehicle is on or partly on the pavement, it is an immediate ticket.
I know it doesn't help your particular case, but what may help is, that if the bicycle parking bays are on private land (i.e. owned by the gym) then the traffic warden has himself comitted a criminal offence in issuing a ticket (it is close to fraud, but not quite) ESPECIALLY if the local council follow it through.
If the park is public, or council land and it is classed as a pavement, then you my friend are fucked.. sorry ____________________ Eurotrip 2009
