PostPosted: 23:03 - 20 Feb 2008    Post subject: DVLA - Revoked license due to not recieving form :( Reply with quote

Heh, my license has been revoked by the DVLA since the 14th January, they kindly informed me today.

Basically, I was diagnosed with Sleep Apneoa at the end of last year, had a tonsil operation about a month ago to try and cure it.

I informed the DVLA that I had SA and they told me they'd send me a form to fill in releasing my medical records to them.

Filled it in, sent it off close to the deadline.

Got a letter back from them saying "If you don't release your records we'll revoke your license automatically, if you've already signed the form, please ignore this letter"

So I ignored the letter, a month passes by (Until today) and a letter drops on my doormat saying

"We wrote to you on the 14th January 2008 to tell you about the revocation of your driving entitlement from 18th January 2008. We also asked you to return the license

We are sorry to have to tell you that we have not recieved your licence(s) which, should be returned immediately. Please may we remind you that the license is no longer valid and you will be committing an offence if you continue to use it".

Sufficed to say, I am absolutely fucking fuming

T

Why did you inform the DVLA about the condition?

Cause presumably if he had a crash and had not disclosed his condition it could be used against him in court. Confused

Because it's a condition that can prevent you from being allowed to drive?

Crikey, you do everything by the book do you?

We all know how useless the DVLA are, if you didn't send it recorded delivery then you can't really complain. How do you know it wasn't the RM that 'lost' it? When your license is at stake, you take precautions...good god man!

Sleep apnoeaIntroductionObstructive sleep apnoea-hypopnoea syndrome (OSAHS) is a sleep disorder in which a person has irregular breathing at night and is excessively sleepy during the day.

In sleep apnoea, the upper airway (pharynx) collapses repeatedly, at irregular intervals, during sleep. Apnoea is when the airway collapses and is blocked completely, cutting off the flow of air. Hypopnoea occurs when the collapse is only partial. The airway is reduced and the person will experience hypoventilation (inadequate breathing).

The pause in breathing, or period of very restricted breathing, is usually defined as about 10 seconds, although it varies from person to person. The frequency of apnoea or hypopnoea is used to assess the severity of this condition. The number of times that the apnoea occurs in an hour is called the apnoea/hypopnoea index (AHI) or the respiratory disturbance index (RDI). An AHI of between 5 and 14 in an hour is mild sleep apnoea. Between 15 and 30 is moderate. More than 30 in an hour is severe that means at least one every two minutes.

As people with sleep apnoea fall asleep, the muscles in their airway relax. The collapsing of the airway (pharynx) causes people to come out of deep sleep and either wake momentarily or sleep lightly, as they are trying to breathe more deeply. The person soon resumes deep sleep, and the cycle begins again. The period of wakefulness is so brief that even though it may happen hundreds of times a night, the person usually won't remember waking up.

Sleep apnoea affects around one in 100 people. Overweight men between the ages of 30 and 65 are most commonly affected, but it may also occur in children with enlarged tonsils or adenoids.

Why should I sent it recorded delivery? DVLA sent me this letter 2nd class, so they can't use that defence on me.

Because they've revoked it because they've ignored the medical release form, not the condition.

They are supposed to conduct an investigation, and they would find that I had an operation that sorted it last month Smile

The DVLA also don't have a licence to lose.

You're a smart lad Toby. you should know anything relatively important should be trackable, cause then at least you have proof that you were compliant.

That is all.

Should i be notifiying dvla of my i-cant-wake-up-before-11am-ness?

Think it might generally effect my riding if i have to go put out a forest fire at 9am, might put other people in danger i think.

Why do you think being excessively tired when driving is a laughing matter? Falling asleep at the wheel kills a lot of people.

Feel great now, I was just hoping DVLA would do the medical investigation, and find that I've been cured and that'd be the end of it. I told them as it's the law to let them no and to be honest not telling them is just as bad as driving without insurance. As I'd be just as fucked if I crashed.

Wankers can't tell when they shouldn't be riding. If you think you might fall asleep when riding dont go out it don't take a genius.

Should alcholics have to alert the DVLA?

Doesn't have to be recorded. Just get proof of postage. It's cheaper. I'm not wasting my money on those money grabbing tossers.

It's the number one cause of fatal motorway crashes.

If i were you, i'd ring them to clarify the situation, and then consult a solicitor.

I cannot believe anyone would send such an important document as a driving licence second class!! Brick Wall
If it goes missing you've only got yourself to blame. Also having proof of postage won't get your licence back and can lead to all sorts of aggro to get a new one.
At least if it's recorded it can then be traced... Wink
