In about a mile radius of my flat almost all the newly painted lines stick out way too much, that is to say they used much too much paint.

Often my bike gets 'train lined' between painted letters etc.. Several times I've nearly stacked my bike in the rain because of the stupid paint.https://www.asdz68.dsl.pipex.com/smile/wanka.gif

So who do I complain to, the council?

Danny,

The lines that are painted on the road contain microscopic glass beads. You know what glass is? slippery. Smile

I'm not sure that the council will do anything because they are supposed to be like that. Its different for a pothole or something. I don't know. I guess that you can always give it a go, what have you got to lose?

Write them a not too snooty letter and you might get some results.

A rise or fall in the road surface needs to be of at least 2 inches before any claim can be made by a pedestrian or 5 inches for a claim by a motor vehicle.

Yeah, that white / yellow / red paint can be a pain, also watch out for the red / greed anti skid stuff they put down, cos when it's new you get the same effect. Merton Council have just done a road near me with the red stuff and green stuff, and it's very easy to get trained on the lines / edges of this stuff.

The thing I found that helps when stuck in a situ like this is to slow down (don't use the brakes, use the engine to slow down) and ride with it in the direction the bike wants to go, don't try to over correct or you will in most cases stack the bike, that way the bike will after 3 - 8 seconds ride off the edge and away from it.

Current rules state that for pedestrian trips and slips the pothole should be at least 1 inch and it has to be proved that the hole was dangerous, in other words it is judged on merit.

As far as potholes on the road are concerned there is no limit, again it has to be proved that the hole in itself was dangerous, that the local authority had a reasonable inspection policy, and that the hole has appeared since the last inspection.

This means that country roads may have a number of potholes several inches deep, but it may not constitute a danger, but a 1 inch deep pothole in town may be dangerous and the liability is complete. It gets very complicated, but since the 1st December 2003, new regulations have made it a requirement to increase their duty of care to maintain roads, but the danger still has to be proven.

New painted white lines would have no chance of success because the Court would hold that every reasonable care has been made to keep the road in good order, and over a relatively short period of time the paint would wear and would not be as pronounced.

1 inch has been the minimum depth for a number of years! It is not a recent change!
