Danny,
The lines that are painted on the road contain microscopic glass beads. You know what glass is? slippery.
I'm not sure that the council will do anything because they are supposed to be like that. Its different for a pothole or something. I don't know. I guess that you can always give it a go, what have you got to lose?

Current rules state that for pedestrian trips and slips the pothole should be at least 1 inch and it has to be proved that the hole was dangerous, in other words it is judged on merit.
As far as potholes on the road are concerned there is no limit, again it has to be proved that the hole in itself was dangerous, that the local authority had a reasonable inspection policy, and that the hole has appeared since the last inspection.
This means that country roads may have a number of potholes several inches deep, but it may not constitute a danger, but a 1 inch deep pothole in town may be dangerous and the liability is complete. It gets very complicated, but since the 1st December 2003, new regulations have made it a requirement to increase their duty of care to maintain roads, but the danger still has to be proven.
New painted white lines would have no chance of success because the Court would hold that every reasonable care has been made to keep the road in good order, and over a relatively short period of time the paint would wear and would not be as pronounced. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |
