Hello all in July 07 i brought a bike from bikers uk in north bassisly hampshire and has had countless problems from head gaskets to new raidiators all under warrenty but on thursday the engine sized. Eairlier that week i noticed there was air in the oil lines so i rang the garage up and said can i bring it down they said just disconect the hose and if any oil comes out its fine so i did that and there was some oil dripping out throught it was all ok so when the engine siezed i took it down there and they said they will ahve a look rang up today and they said they havent stripped it yet but because there is air in your oil line you have let it run out of oil so there will be no warrenty claim. Well i havent filled it up last month and there is still around half a tank in there. So please were do i stand is there any way to convince them that i did not let it run out of oil? sorry for long post and throughts will be much appreshiated thanks Dom

luckily those engines are used in pretty much all geared 50cc bikes so ebay or any moped or scooter shop should do them.

I think a piston kit is £20-£30 and barrel and head is about £100 depending on where you get it.

Thing is for £20 more you can get a big bore kit if you wanted.

for now i would get on the phone to trading standards ect. A little complaining goes along way, i know you may think your being an arse but honest it gets you places.
They will fix it, just drop it off and refuse to pick it up till its fixed :p or something along the lines. Its what my mum did it when her car had an accident and they touch painted a panel the wrong colour or something, it soon got done :p

fight it dont let them be dicks.

Oh and if the worst comes, a cylinder kit is what you need, go on ebay there not expensive and usally better than the originals lol.
They come with the gaskets, cyclinder and piston head. Its gonna be a arse to get off like because it sounds like the piston is welded to the cylinder Neutral

Good luck!

Get all your paperwork sorted:
Arrow Purchase Receipt.
Arrow Paperwork from previous repairs.
Arrow Phone bill showing call made before engine seized.

One important thing to consider are how you paid for the bike. If it was on HP or via a credit card then you could involve them as they have some liability. If necessary you can start a disputed payment claim with them which is a very good tactic if the dealer continually delays. Even if you only paid the deposit via credit card then as long as it was over £100 then you still have some protection.

Once you have all of this info then write to the dealer explaining what happened and ensure that you enclose copies of all the paperwork and send the letter via special delivery. From know on do everything via letters sent recorded/special delivery, and keep a diary of their contents, when they are sent etc. If the dealer phones you then immediately write down what was said and then write to them reminding them of what was said during the conversation.

Read up on the Supply and Sale of Goods Act 1994 - Clicky - as this is what covers your claim. Basically the goods have to be of satisfactory quality and if you can show that you have had numerous problems then you can actually reject the bike. The dealer will try anything to avoid this and should try and help you.

If they don't budge then it would be best to speak to Trading Standards and any Trade Bodies that the dealer is a member of. Also if there is any credit card/company involved then this is the stage to enter a disputed payment claim. The credit company would send you a form to fill in and if they think you are right they will take the money back from the Dealer, credit your account and enforce their dispute process. They then look at the info from both sides and if they agree with you then you keep the money and the Dealer gets the bike back, warts and all.

Alternatively you could just go down the Small Claims Court route, which is pretty cheap, does not need solicitors, and isn't that scary.

.

Not quite correct.

SO LONG AS YOU PAID ANYTHING ON A CC.....
and the purchase price was £100 or above. Thumbs Up
The deposit, does not need to be over £100, it could be as low as a £1 and the rest of the purchase price is £100+

You may be covered under the CCA.

But to do so you/card provider have to prove breech of contract. Which could be hard is dealer is saying that its your fault, as it run out of oil.
But that should be easy to prove if you say it was only just serviced. Get the dealer or Aprillia to quote how long a tank of oil should last, and then compare to the milage you have done. Thumbs Up

Definitely be worth more with a standard top end on.

I'd still be chasing up the place you got it from, though.

I can't help wondering how much "work" your mate may have already done on your bike? Confused

It sounds like you may have run it out of oil before you filled it last time and this is what has caused the air & the seizure. Himself (qualified Aprilia workshop manager) reckons those engines only sieze for 2 reasons, either thy have run out of oil or they have run out of water. He reckons he's seen hundreds of them and never seen one sieze for any other reason. Sorry. Sad

How many miles has it done?

To get anywhere you are going to have to get a independent report on the damage.
This will not be cheap.

Was the bike brand new when you bought it? How many times was it serviced in those 8000 miles and who did the services? Did you go back to the dealer? What exactly were the nature of the problems it had already had that were fixed under warranty? All of this is relevant..............

(PS you still haven't answered my original question. Wink Has your mate "worked" on your bike? Suspect I know the answer.................)

He also says if you're going to do it yourself get on google and look for a Polini top end, should cost you about £70.
