Well just returned from the hospital on crutches after an accident this morning.
Nothing serious just damaged my hip so need to keep the weight off for a while.
excuse the hideous diagram. art was never my strong point Smile

so i heading up between the 2 roundabouts and this dozy cow in a bmw keeps changing lanes in front. no indicators just swapping lanes on the approach to the roundabout.

just as we enter the roundabout with her in the left lane she indicates right and starts to turn then suddenly swings left again and stops dead.
At this point i hit the brakes hard and go vertical on the front wheel so i'm staring at the road with my front tyre just touching her rear bumper.

unfortunately the bike just leaned to the left and dropped hard on top of me. as i'm lying there trying to pick myself up she cuts right and drives off !

i managed to get up and went to run after her but my hips was on fire so didn't get far. fortunately a car drive who had witnessed the whole thing drove after her to get her plate and try and stop her.

2 other people helped me pick the bike up and get it to the side of the road. the only damage i could see was a broken foot peg and the left handle bar is bent.

the guy who chased after her pulled up and said that she was "causing chaos on the other roundabout. driving round and round it" but he got her plate.

then...she appears behind us and stopped next to me and said "oh i'm sorry dear i didn't see you"

i asked her if you knew what happened and she admitted that she was lost and had stopped dead because she wanted to go back round the roundabout.

i asked her how on earth she didn't notice a bright blue red and white motorbike vertical up against her rear window.
she said "i'm lost and have to pick up my husband and was busy looking for him"

arghhhhhh!!!!!! dippy cow

i'm more p1ssed off than anything and want to get back on my bike.

Quick Edit: I called the police who said they will report her to traffic as she left the scene of an accident was driving without due care and attention and gave me a crime reference number.

She has offered to pay for any repairs etc but i was wondering if i should go to one of these claims companies to get compensation.

Anyone done this and offer any advice?

I would advice anyone not to except cash payment, especially if injuries are invovled.

Are you fully comp? If so use it to cover everything and go through insurance.

When I got knocked off I went through so much hassle getting quotes and what not to get money off the guy. He was fine and payed up no problem. But the place i got the quote from said that they could not do the work for that price (something to do with the paint) and I still haven't got that panel repaired.

The only time I would except cash is if the bike is at an official dealership and they come in and pay the bill before the work commences.

Saying that if you are TPFT/TP accepting cash might be the better option as I have been waiting 10 months for my simple claim to be sorted The damage is £2k in hindsight if the bloke offered me £1k there and then I would have accepted it.

i'm only tpft so thought about using one of those claims companies.
she seemed very reluctant to go through her insurance for some reason so i'm thinking of billing her for new side fairings, foot peg and screen and see how it goes.

Bad luck fella. You're OK which is the main thing. I'd ask the police what the best course of action is as there wasn't actually a collision.

Being lost though is no excuse for sh#te driving

Probably because she has loads of claims, I would advise going through insurance your lucky you have witnesses I didn't and the other insurance company know they are going to lose so are just gonna drag it out to keep hold of the monies for as long as possible.

If you call BLD (bikers legal defense) they will take your claim, you also get a hire bike (I got a blandirt 650) The other insurance company should pay out ASAP because you have witnesses and she has admitted fault. The fact you have a hire bike means they should pay quickly as it will cost them £80 each day they don't.

I'm sure there are other companies that do the same thing but BLD is what I used. If you call them now I reckon you will have a hire bike by miday tommorrow!

your insured for third party accidents so you don't need to contact anybody else but your insurance. they will do the rest.

you don't need to call BLD or anyone AFAIK.

If i contact my insurance won't they increase my insurance premium even though the other party admitted fault?

You have a very strong case, definetly go through insurance.

The fact you have a hip injury means you can claim for injuries and inconvenience also.

Dippy old woman.

Won't affect your insurance.

You policy will only increase if you cost your insurers money. N30 is right speak to the first, if you already have legal cover with the insurance use them. (BLD where the company my insurance gave me)

no, your not the one at fault so your no claims etc. don't get affected.

when i had car accident a few years ago which wasn't my fault.
i was t-boned at a junction and the other party excepted full responsibility but my insurance went up.
the company told me that because i'd been in an accident i was more of a risk even though it wasn't my fault.

hopefully it won't happen this time.
i have the name and number of the main witness who was in a car behind us and witnessed the whole thing. he also chased the woman after she left the scene and witnessed her driving erratically after the accident.

Stupid woman ! It really annoys me the number of drivers that think mirrors are for show, even fewer that even think to check the blind spots...

Thanks for the support everyone.
I'm gutted especially as i'd not ridden for a week having been away with work in Germany.
Jumped on this morning really looking forward to my ride to work and was taking it easy after my mini break riding extra careful and this happens.
Usually i'd have nipped past someone like this and been gone instead of taking it easy and hanging back.
Oh well...

Unlucky buddy, the trip must have lured you into a false sense of security about bmw drivers.

I'm not sure if I'm reading this right but if you hit her from behind then you might be having trouble with any sort of claim, especially if you let them know you had seen her driving erratically beforehand, I'd see what sort response you get when you give her an estimate.

Was there any damage to the car?

there were no marks on her car and she admitted that it was her fault.
she also left the scene and if it wasn't for the witness who saw the whole thing chasing her down then she would have buggered off and left me footing the bill.

i'm used to erratic drivers which was why i dropped back.
however the highway code states that if you are on a roundabout and realise you are in the wrong lane then you should continue on until you find a safe place to turn etc

she indicated right turned left canceled indicator then jammed the brakes on and turned right again to make it round the roundabout.

the witness corroborated everything and also noted she was causing chaos at the other roundabout by going round and round whilst looking for husband ! doh !

she seemed quite sure about not involving her insurance for some reason and settling the costs privately.

makes you wonder .........
