Had my 1st accident on my way to work .busted water main the road was like a ice ring.
Had no chance. Black ice everywhere. Just wanted to know if I can claim off the water board as one of the work man said that the mains had been burst for 2-3 days, and there was no road signs or warnings saying there was a burst water mains or any ice on the road, no grit either.

you'll need a witness(es) or CCTV of some sort to even start a claim.
And if your local water board is anything like Welsh Water, good luck because welsh water is contract run which means liability will take forever to be sorted/admitted/who's even liable. ____________________ Past - CG125 ,KR1S, SV650s, Street Triple R - Current - Duke 390

Well if you don't try you won't know.
Get onto local council. Gritting the roads is their responsibility and if it had been leaking for the length you said they should have been informed and aslo sorted some warning as well.
I hope you reported this to the police and council at the time of the crash.
Give one of the bike solictors a call and see if they can assist you with your claim...

thats a bummer m8 glad your ok
you need to speak to a legal advisor as i think this is a high-ways claim ie local council or county council as the road was under repair and therefore should be under highway control and they will recoup any cost from the water board
you could try citizen's advice but with all the doom and gloom atm there gonna be seriously busy.
you could also try one off these ambulance chasers BUT BE VERY WEARY as there in it to fleece every fooker  |

Shame you came off but at least now you have an excuse to replace those gash indicators
You should be able to pursue a claim against the council, a mate of mine did exactly the same as you on a burst and frozen water main in Southampton and he claimed successfully. His had been reported previously though, as it was right outside a bike shop and they had reported it.

Ive just phoned my insurance, they have offered me £3228 for the bike.. But got to take the £500 access off.. So I'm supposed to have £2728 left..
Now they have just phoned and said that they are now going to take another £350 off that for accidental access??!.. The rest has been sent off to the finance company. So what i've been paid for it isn't enough to cover the finance on it..
They've done all this without notifiying me. I haven't had any letters confirming how much I was supposed to have had... and my bike is in a salvage ward and is a cat.D, So looks like they are going to sell my bike aswel as it only has cosmetic damage.. But they said it was still going to cost too much to repair. So as it stands.. Im now still £660 in debt.. with no bike!.

I'd take some legal advice pronto if I were you. Sod BCF, get on the phone to someone who sorts this kind of stuff out every day.

got a letter from insurance today the first 1 i have had from them it says .
date of loss 14/01/09
policy exesess £500
we write to advise that your vehicle is beyond economical repair.
your vehicle has been inspected by a independent engineer.and the market value is £3228.
the policy excess and outstanding finance under the hire purchase agreement will be deducted .please forward as a matter of urgency your vehicle registration and certificate of motor insurance.we have moved your vehicle to safe storage and would like to dispose of it . we will be contacting you to obtain your agreement .in the next few days.
in order to comply with dvla requirements and to discharge your responeibility for the vehicle .it is extremely important that you detach and complete section 9 of your vehicle registration document(v5) and put insurance companys name in the title .so phones them up to see what the other £350 is for as its not on this letter.she said its because i am over 35 and its on my policy .on my policy it says voluntary excess £500 compulsory damage fire and theft
£350 i said i was not told about this .but its not on the letter .(was told to read my policy )so i said i will have my bike back then .she said u can have your bike back but i will have to pay for it .and they will take it out the sum we give you. but how can you do that when you have already paid it to the finance company without my permission? She said we tried to ring you on the 30th of january but the phone just rang out. Had a look at my phone and there wasn;t any missed calls from the insurance company. So they just assumed that I would accept the offer which they have now paid to the finance company. so now if i want my bike back I have to buy it from the salvage company.

£850 excess on a £3k bike!! How much were you paying for insurance?
