I don't know where to stand on this one.

Either it was yet another gross screw-up by the intelligence services, these guys were completely innocent, and now face deportation for no reason.

Or, on the other hand, they were actually involved in something but were tipped off in time by the photograph of Assistant Commissioner Quick carrying an intelligence dossier in plain sight.

Either way, they were detained for 13 days without charge. Civil Liberties? They only matter when we are criticising other countries!

Or as many predicted it was done as a distraction for the G20 protest violence or as a cover for the Smear stories.

Or their civil rights are being adhered to and time has run out to gain the information required to hold them longer. So there may be information and evidence about them but not long enough to hold them and seeing under the terrorism act they can't be bailed the only alternative is to release them. I was listening to a solicitor representing a few of them and he was saying that all the rules have been strictly adhered to with regards the treatment of his clients. In the same report the police had said that they had run out of time to collate information to be able to hold and question further the suspects and had to release them.

So the police had intelligence that they were being naughty,
They tried to get hard evidence but there wasn't enough to bring charges for one reason or another.
The suspects were let go.
They will probably get a few quid in their back pockets for the inconvenience too.

The trouble with the terrorism thing is unlike burglary or say car crimes you can't get the hard evidence quickly, you can't let the act be carried out and catch them later with all the evidence at hand, you need to intervene late enough to get as much info as possible but early enough so that they can't act out their crime.

I know when I used to monitor people we would get some information, we would look into the information given, set up monitoring equipment and then wait for the person to commit the crime. Only when we had evidence of them doing the crime would we act, unfortunately if it was terrorism it is too late when things go bang.

Terrorism is a very hard crime to prove before the act, but a very easy crime to commit. That is what puts the terror into terrorism.

Some may say what about the 12's civil liberties. I ask what about mine?

Well it has been proven time and again that the UK government will play politics with the police. Ie the de menezes affair where all the CCTV footage mysteriously vanished.

Also the lies told about Tomlinson's death at the G20 protests.

Or the lets deploy tanks at heathrow airport to cow the population into supporting the Iraq war.

On that note lets lie to go to war with Iraq!.

Or the political arrest of Damien Green in effect political prisoners.

And that is just a very small example there are 100s.

Ever hear of the story of the boy who cried wolf?, the government has cried wolf far too many times and thus there might well be a real wolf but people have been turned cynical about this.

If it was lower key ie instead of Brown standing up and on TV announcing that a serious credible and REAL terrorist attack has been averted then I would be less cynical of their motives.

A serious and credible threat is if you find detailed plans and or explosives and when I say that I don't mean everyday items you can make explosives out of since that is grasping at straws.

However since brown did stand up and say those things it makes you think it was a politics play that was done to distract attention away from the G20 and or the email smears thing , this is the kicker and this is the controversial bit.

Because it is law it is right? My point is that detention without charge is wrong whether it is 'justified by law' or not. We constantly harangue other governments for lack of human rights and yet we are doing the same thing ourselves under the pretence of protecting the public from terrorism. Let's face it, the government has done all it can to create fear of terrorism completely out of proportion with the threat. Was there this kind of public scaremongering when the IRA were running rampant? Was there bollocks.

The public reason we won't allow Turkey to join the EU is their human rights track record and yet they can only hold someone for a week without charge. We can do it for 28 days.

The other question is, if the intelligence on these guys was so solid, and they posed such an immediate threat, how can evidence not be found in 12 days?

One of the stupidest questions I've ever heard. Your and their liberties are exactly the same.

Are you suggesting that everyone accused of committing a crime should have all rights removed? What if next time a cloned bike is used to collect 'terrorist supplies' and it happens to be your number plate? No liberties for you skudd!

To paraphrase Ben Franklin, "I'd rather see 12 guilty men go free than to see one innocent man imprisoned".

Their rights were adhered to, that is why I fear Ben Franklin's quote may be very apt.

And I'm sure you'd be repeating that bilge while standing on the gallows as they put a rope around your neck for a crime you hadn't commited. "Yep, go ahead chaps, top me for the greater good!"

How were their rights adhered to? They were imprisoned for 12 days without charge. That's the sort of human rights breach we jump on the backs of "lesser nations" for.

I honestly think you are confusing human rights with legality. Because it's legal in this country doesn't stop it from being a breach of human rights.

Parliament could pass a law tomorrow that institutes a mandatory death sentence for littering. Would it still be right?

I'm new here mate, so I'm not sure of your background, but are you / were you a copper?

As much as I'm not a fan of the yanks, this is possibly one of the greatest paragraphs of writing produced by human minds in several millenia (despite the Creator references).

This is where the human rights argument goes back to. All men should have certain inalienable rights which must be safeguarded.

I've corrected that quote for historical accuracy.

So you still believe they're guilty? Is it because our notoriously infallible police say so? Or our fair and balanced media? Or just cos, you know, they're 'a bit brown'?

First up, our law (and modern democratic society) is built upon the tenant that we're innocent until proven guilty. Secondly, these 12 could've been held for 28 days if there was even the slightest hint of evidence against them, but no - out after less than half of it!

I don't know either way, but saying I'm a racist or that I blindly follow the media and the Police as a form of defence is laughable. In your mind they are innocent because the police arrested them and you are anti everything police wise.

With regards the 28 days, they need good evidence. the police stated that they didn't have time to get the evidence needed to hold them further. Can't bail them so have to let them go. So their rights have been upheld. Can't see a problem with that. the police had information, they pulled them in to ask questions and get evidence, couldn't get enough evidence in the set time scale. Police let them go. It is the sort of crime that to get 100% evidence is too late, so they have to try the next best thing which then makes things shaky.

Are they guilty? I don't know

Have they acted like students as they say they are? It appears not.

Why are they here then? Perhaps the questioning couldn't ascertain the facts.

Is it worth asking the question? Too damn right it is.

I was under the impression that they were here on student visas but none of them were actually attending a college but working as security guards!

I would think that suspicious in itself regardless of any intelligence crap

Sure, none of them were students. That's why two of them were arrested at gunpoint at the Liverpool John Moores University Library. Definetly something dodgy going on there!

Two of the twelve weren't on student visas (one was a British Citizen) and two of them were arrested in Clitheroe whilst working as security guards. It isn't specified whether these two were the non students.

Also, I hate to point it out, but an awful lot of students have to do part time work to make ends meet whilst studying.

I'm no hetzer here, I'm definitely not anti police. There has to be keepers of law and order else society fails. I am, however, increasingly skeptical of the current erosion of rights by the government/police.

I offered my suggestions as to why you may believe what you believe and it still appears that at least 2 of my three questions were in the right ball park:
-other have already mentioned that you believed the media mention of 12 on student visas without question
-through your rhetoric you appear to be very pro police (probably worked with/for them?)
-I'll hold back on the racist, i was just being a bit belligerent, but questions like "Why are they here then?" do sound a little daily mail.

Skudd wrote:

No, they're not - they haven't been convicted by a jury (nor even charged). Thus we have to view them as not guilty. The whole point of the justice system is to protect the innocent, if suspicion becomes as good as guilt then the innocent are no longer protected!

Quote:

The information that we all have has come from media of some sort. When listening to the solicitor of two of them he stated they were on student visas. I do not know of the others as I have not been in the interview room sat next to them. The police spokesman stated that others ( not THE others) were on student visas. Some are believed to be nationals, so I'm not sure where you get this " without question" bit from, or is it just a way to try and undermind others views?

In manchester just out of one college their are over 50 students who either do not turn up for lectures or have attended only a few lectures who are on student visas, these people are being investigated. The question needs to be asked. If the answers are ok then thats fine.

Quote:

It is not that I'm pro police it is that I haven't jumped on the anti police band wagon. Yes I have worked with the police very closely in the past, but there again I have done loads of youth work and the like. most would call it being a rounded person. I have also had my fair share of tellings off from the police too.

Quote:

I know they haven't been charged/convicted by jury. Are they innocent? I don't know. Being guilty of a crime doesn't need anyone to know you have done it let alone gone to court to be convicted.

If my wooden fence went missing and my next door neighbour was having a big bonfire, would it not be prudent to ask him where he got his timber from, doesn't mean he is guilty of the theft my fence, but it would be worth asking the question wouldn't it?
