Hey,
I've recently gotten rather annoyed with my gym and wish to quit.

When I first joined up it was a quiet little gym, however just recently they've been packing the members in and its become almost impossible to get on any of the equipment. Just tonight I rolled up and was unable to park because it was so packed! I ended up turning round and going home!

I have a 12 month contract which I signed at the beginning of this year (I cant find my copy of it now :S )

I have drafted a letter to the gym telling them I'm quitting and on what date the last payment will leave my account (Im cancelling the Direct Debit after that date)

Slightly worried about the 12 month contract. Can i simply tell them im quitting and cancel my Direct Debit?

Just wondering what you BCF oracles thought.

Gyms are shit for contracts. I don't understand why you need to sign 12 month contract, or why they need 3 months to cancel your membership after the first 12 months. I'd happily pay the same I was paying on contract but monthly, if that was the case I'm sure I'd still be there now rather than cancelling membership and not bothering to rejoin as I don't want another 12 month contract!!

Sparks, surely you're not that naive?

Most people have the motivation to go down the gym for one month, maybe two. Getting them to pay for 12 is the only way they stay afloat. At least the big swanky ones.

Join a gypo one like mine (if you can find em). Think they've opened another one. £13 a month and for that you get... well, next to fuck all. But theres equipment, occasional totty and they open the windows if you ask nicely.

I know EXACTLY why they do it, as I'm guilty of it myself, went for a few months then eventually ended up paying £50 a month and not even going... hence why I think it's a bit of a con... albeit, my own fault for not going.

The gym i work at operate a 12 month contract. When you sign up you are agreeing to join for a minimum of 12 months and as such make a minimum of 12 direct debits (might say something similar in your terms and conditions - ask for a copy from the gym as you've lost yours).

Be careful about cancelling the direct debit as they're likely to try and take another payment to coincide with your 12 month contract, and as the direct debit will no longer exist, they will class this as a missed payment and put an additional charge on you for it. So then they will class you as being in arrears as well!

Most contracts operate a 3 month notice period but that's still 3 months that your paying for and not using.

As for the trading standards thing, they can admit as many people into a gym as they like until health and safety rules and regulations kick in. They would probably argue that all gyms have peak times, and it is not their fault that you choose to attend at said times. It's also not their fault that you choose to drive there and sometimes can't find a parking space. I'm guessing they never said car parking was always garunteed?

Either way it's all standard stuff. What i''ve said is based on the way my gym operates concerning contracts and membership. It's not to say that it can't be challenged, but i don't know whether it would swing in your favour. If you don't ask you'll never know.

Either way i would strongly suggest not cancelling your direct debit for reasons mentioned above. Write your letter first, get a resonse from them, and if they say it's fine then cancel it. Otherwise hold fire for fear of incurring unwanted charges.

Send it via recorded as proof of delivery of when it was sent plus request a copy of your contract, as they have to sign for it which will acknowledge receipt of it, but do retain a copy of it for your own personal records and, if need be, to show Consumer Advice/Trading Standards along with their response to what you've stated in that letter rather than just hear say to see if there is an unfair term in your contract or not?

The trouble is you have probably entered a credit agreement with them where effectively they have loaned you the money for the membership and you are paying it back in instalments. Have a look at your membership form and see if it mentions the Consumer Credit Act 1974 which makes it much harder to wriggle out of it.

I had an issue with Esporta and gave them one months notice then cancelled my direct debit. They threatened debt collectors etc but I stood my ground - there's plenty of info on the net. When their 'solicitor' wrote to me saying we were going to court I wrote back saying how pleased I was as it will make every contract they have signed for membership null and void. Surprise, Surprise it was the last I ever heard from them. The difference with me though was that I'd completed the original 12 month agreement.

I think you'll find if you suggest that the original sales person told you that you could cancel it within 12 months, stick to your guns and be prepared to say that in court (which it will never get to) then eventually they will leave you alone.

I now go to an equally good gym for £14.99 a month instead of nearly £80 with no cancellation period or 12 month contract.

Also, the 3 month notice period has been ruled unfair by the OFT, IIRC.

Scan a contract in omitting your personal details and I'll go through it.
Easiest way is to actually do what Joe has said and deny knowing it was for 12 months.
If it's covered by the CCA 1974 there are certain aspects they have to adhere to as well.

Thats how Ballys does it in the US. My AirForce CO wrote them a letter stating I would remain a member if they opened a branch in Kosovo during my (nonexistant) deployment. Wink

Go and ask at the Gym, what the terms are.......

Don't cancel the DD. If you have ever given them your card details to pay for say the 1st month, or to prove your age, they will use that to take payment.... That will be very hard to get back as they will simply say that you were in contract and stopped the DD.

My gym specifies they may cancel the contract for various reasons, including your general unsavoury behaviour and letting other people use your card.
I was thinking that if they wouldn't play-ball and I wanted to leave, I'd set up a rota of tramps to use my card each day - they get a free shower - maybe even the chance to sit down and beg the pretentious people for 20p and I quite quickly get it cancelled Smile.

I was thinking along the same lines i.e be very lewd to the females, perhaps expose yourself a few times, makes passes at the receptionist, be loud, leary and sweary, 'accidently' break 8 pieces of equipment in a row, take a tuba in with you and play a 'fat mans march' type tune behind the fat people on the treadmills.......the possibilities are endless....

speak to them about, make something up about why you cant come again ad why you would wish to stop payment.

I had mine suspended whilst I was travelling, then when I came back to the UK they transferred the membership to another gym, near where I'd moved to, and I didn't have to pay a thing for just over a year.

When I got back I wanted to use it.

You could always do the whole moving area/country thing on them, they have no choice but to suspend it.
