How to quit the gym

Hey,
I've recently gotten rather annoyed with my gym and wish to quit.

When I first joined up it was a quiet little gym, however just recently they've been packing the members in and its become almost impossible to get on any of the equipment. Just tonight I rolled up and was unable to park because it was so packed! I ended up turning round and going home!

I have a 12 month contract which I signed at the beginning of this year (I cant find my copy of it now :S )

I have drafted a letter to the gym telling them I'm quitting and on what date the last payment will leave my account (Im cancelling the Direct Debit after that date)

Slightly worried about the 12 month contract. Can i simply tell them im quitting and cancel my Direct Debit?

Just wondering what you BCF oracles thought.

Gyms are shit for contracts. I don't understand why you need to sign 12 month contract, or why they need 3 months to cancel your membership after the first 12 months. I'd happily pay the same I was paying on contract but monthly, if that was the case I'm sure I'd still be there now rather than cancelling membership and not bothering to rejoin as I don't want another 12 month contract!!

Most people have the motivation to go down the gym for one month, maybe two. Getting them to pay for 12 is the only way they stay afloat. At least the big swanky ones.

Join a gypo one like mine (if you can find em). Think they've opened another one. £13 a month and for that you get... well, next to fuck all. But theres equipment, occasional totty and they open the windows if you ask nicely.

The trouble is you have probably entered a credit agreement with them where effectively they have loaned you the money for the membership and you are paying it back in instalments. Have a look at your membership form and see if it mentions the Consumer Credit Act 1974 which makes it much harder to wriggle out of it.

I had an issue with Esporta and gave them one months notice then cancelled my direct debit. They threatened debt collectors etc but I stood my ground - there's plenty of info on the net. When their 'solicitor' wrote to me saying we were going to court I wrote back saying how pleased I was as it will make every contract they have signed for membership null and void. Surprise, Surprise it was the last I ever heard from them. The difference with me though was that I'd completed the original 12 month agreement.

I think you'll find if you suggest that the original sales person told you that you could cancel it within 12 months, stick to your guns and be prepared to say that in court (which it will never get to) then eventually they will leave you alone.

I now go to an equally good gym for £14.99 a month instead of nearly £80 with no cancellation period or 12 month contract.

Also, the 3 month notice period has been ruled unfair by the OFT, IIRC.

Scan a contract in omitting your personal details and I'll go through it.
Easiest way is to actually do what Joe has said and deny knowing it was for 12 months.
If it's covered by the CCA 1974 there are certain aspects they have to adhere to as well.

My gym specifies they may cancel the contract for various reasons, including your general unsavoury behaviour and letting other people use your card.
I was thinking that if they wouldn't play-ball and I wanted to leave, I'd set up a rota of tramps to use my card each day - they get a free shower - maybe even the chance to sit down and beg the pretentious people for 20p and I quite quickly get it cancelled .

Get a bill or something in your name and change the address to a mates address miles away and say you have moved out of the area.

Worked for me.

I had mine suspended whilst I was travelling, then when I came back to the UK they transferred the membership to another gym, near where I'd moved to, and I didn't have to pay a thing for just over a year.

When I got back I wanted to use it.

You could always do the whole moving area/country thing on them, they have no choice but to suspend it.
