 Posted: 22:05 - 13 Sep 2009 Post subject: Problem after selling a bike to a mate |
 |
|
OK, I'm a cock, I freely admit it. I sold my white CG to a mate, we agreed £350 and shook on it, he gave me a £100 deposit and agreed to pay me £50 every week until the debt was paid. I sent the V5 off on the basis it wouldnt take him long to pay me off. The deal was made on the stipulation that he could have the paperwork when half the remaining £250 had been paid.
The first problem arose when he wanted me to knock the price down to £300 as he said thats what we'd agreed weeks before. I said that would be fine because he's a mate. then the points went so i knocked the price down again to £250 and said that i'd hold on to the service history till he'd paid me in full. He blew it up (he'd blown up another which is why he needed mine) I told him I couldn't knock anymore off as he'd already done over 1000 miles and ragged the nuts off it even though the piston was only 5 miles old when i sold it. So far he's given me £135 and won't give me the other £115. He's now hassling me to give him the paperwork, what exactly can I do BCF? I don't want to be a complete cnut about it but I want what I'm owed.
Also could nobody remind me that I'm a complete wazzock for letting the bike go before I had the cash in my hand. First and last time, I've learned my lesson ____________________ '84 TS50X, '91 TZR125, '89 CBR400RR, '91 VFR400R NC30, '98 R1

Unfortunately I sent the V5 off because he was a mate and I thought I could trust him, looks like i was wrong, and I'm prepared to live with that fact. I'm dragging my heels with it as much as possible and will bring it up in conversation if he turns up for the the paper work. he doesnt know when the mot runs out, which is why he wants it, im tempted to 'lose' the bits he needs, then he cant tax it and might get a tug for no mot, make his life a bit difficult ____________________ '84 TS50X, '91 TZR125, '89 CBR400RR, '91 VFR400R NC30, '98 R1

I would say you have the right idea of holding back the MOT etc, but it's not guaranteed to work. I'm sure there are ways around it to be able to get the bike taxed again - situations where people have lost the MOT and have to get another one or when you only have to use the tax reminder letter thing in the post?
Just one question though, how on earth do you blow up a CG engine from just 1000 miles? I think I can imagine how but it takes a very large amount of stupid
A final thought:
Take parts off of the bike that you see as the value of what he hasn't paid for. After all what defines a bike.... the engine or most importantly, the frame?
Find it and take the wheels, mirrors, cables, side panels etc. You know, the stuff you could easily sell on ebay as parts and is worth what he hasn't given you. You'd probably get away with it if he can't prove it was you ____________________ will never give up his CG. I look at my fuel gauge more as a progress bar than a fuel gauge.
G: With my GSXR I do often effectively use it as a scooter with a clutch in town.
ms51ves3: why does it need 500 miles? Are you teaching it how to be a piston? |

i was wondering about 'accidently' setting fire to it then he'd be screwed, but its really not worth my time trying to arse about trying to get it off him if he's adamant he owes me nothing.
i told him he needed to limit himself to about 40, just to run the piston in, he'd blown up his other one in 4 miles and i told him id literally just put the piston in and it needed to bed in. the first thing i hear is 'vroom, vrooom, vroooooooooooooooom nananananana vroooooooooooooom' as he pulls out of my driveway onto the a11 not surprising the rings melted tbh
i heard it the other day actually, sound like a right heap, took at least 8 kicks to start and rattles like anything. also he managed to totally destroy a set of BRAND NEW sprockets in 2500 miles my last set lasted me 5000, with plenty of life left ____________________ '84 TS50X, '91 TZR125, '89 CBR400RR, '91 VFR400R NC30, '98 R1

Lol what an IDIOT!
My last set of sprockets and chain lasted me way more than 5000 miles Also it's more about the revs you keep it at rather than the speed right? My CG will do 40MPH in 5th gear at about it's lowest possible speed before it stalls. And if it was you that managed to replace the piston rings / piston the last time what's stopping you from doing so again? It's possible that the cylinder is still fine! Could open it up for a look? ____________________ will never give up his CG. I look at my fuel gauge more as a progress bar than a fuel gauge.

there is nothing to stop him just getting an mot, he doesnt need to have the old one to do it.
equally there is nothing to stop you telling everyone what he has done, or filing in the small claims. ____________________ Fallen Angel "Nae sniffing my seat now!!!!! "

Tell him to get stuffed re the paperwork. Tell him a deal is a deal, and to pay it.
Do as Robby suggests and reclaim the tax. I know you say your Dad will be disappointed if you tell him, but it might be handy to have a grown up on your side when your mate comes a calling...
And if it all goes tits up, then 'shrug it off' and walk away and don't EVER give the twat any of your time ever again... ____________________ Be who you are and say what you feel, because those who mind don't matter, and those who matter won't mind - Dr. Seuss |

My younger brother has a good way of dealing with situations like that. He just goes on and on about it incessantly and if he gets no response, he goes on about it more.
So every time you see him say "Where's my £100?" as the first thing out of your mouth. If he comes about with complaints etc, the answer is "Yes, but where's my £100?".
If you get nowhere, start sending texts saying "Where's my £100.". Ramp up the frequency of them as time goes on, themn move onto emails and facebook.
He'll eventually loose his rag and tell you to stfu about the £100. The answer to this is "Yes, I can see how that could be getting annoying, but where's my £100.".
Use any excuse to bring it up "How much was that new computer game?" . "Oh, it was £22.99, which is quite a bit less than the £100 you owe me.".
What's the time? "About £100.. sorry, 20 past 11".
He'll eventually crack. ____________________ “Rule one: Always stick around for one more drink. That's when things happen. That's when you find out everything you want to know.”

I take it that as you sent the V5 in to change the name you also put his address on it..... As the new owner.
As that is the only paperwork he needs to do anything. You are pretty much stuffed.
If you left it with your address on, then i would SORN it..... Might just get him caught out.
Getting the V5 back in your name, could be a interesting move unless you can get the bike off him.
He could simply run every speed cam and you could well end up with a load of points and fines.....
Or to be real evil
Get a plate made up. Give him the V5 and say you had enough and can't be arsed anymore....
Then run a few speed cams
Do you not have any other mutual friends that can be used to apply a bit of pressure, or have a word with his parents to see if they can make him cough up. ____________________ Just because my bike was A DIVVY, does not mean i am...... |

A V5 in your name just means you are the registered keeper, not necessarily the owner.
That's why you should always do a bill of sale when buying/selling a vehicle.
You could clone his plate and go park on a load of double yellows. ____________________ “Rule one: Always stick around for one more drink. That's when things happen. That's when you find out everything you want to know.”
