hey peeps just a quick post on here i had my 1st prang on the bike today on the way to work and just want to check for a bit of advice really Very Happy and i will share the infmous paint diagram with you ! Razz

anyway i was traveling on the way to work, still in daylight with my headlight on, heavy traffic, so i begin to filter at around 25 mph. Out of a side road a large car comes across my path to go accross the road, i slam my breaks on and must get down to about 10mph before i hit her.

I went straight into her wheel !!! no damage to her car, i fall off one side and the bike falls to the right on the exhaust.

A passing biker stops, few people come out, biker helps the bike up, the driver was a friendly woman who admitted it was her fault and said she moved out because the guy i just passed flashed her to move out, she knew she should of checked but went anyway.

The nice biker man Thumbs Up Thumbs Up got the bike to the side road for me and i exhanged details, her car looked perfectly fine and at first glance so did he bike, so i said ill get someone to pick it up and check it over later..

so i go to the doctors, have some bruising, sprained / broken wrist and aching back, if the pain in my wrist doesnt go, goto the hospital for an xray

get home to see my bike and it has some scrapage down the side it fell, the exhaust seems loose and has dints in, the rear break doesnbt work and some of the body work has cracked and broken off in one place, the front end seems "sloppy" and the front wheel "feels loose" and bent levers , scratched mirror ect and it makes a "clicking, knocking noise" when moving

Pictures to come tomorow !! anyway my bike is only worth about £1000 anyway, im more annoed my bike looks like a pile of shit cosmetically now as i liked to keep it mint :

now ive never had an accident before, whats the drill, i just contact my insurance and they get the ball rolling ?

do i need to notify the police ? do i need to tell anyone else ?

just advice really, what TO DO and what TO AVOID,

thanks in advance for the help guys Very Happy and thanks to helpfull learner biker guy who said "ohh i was following you because you had a licence and i thought you would be safe" lol Very Happy

Sorry to hear about your prang, glad you're relatively okay though. Officially yes, notify her insurance if you want to make a claim. Beware that it will make your next premium higher though so weigh this up against how much it will cost to fix the damage/loss of earnings due to injury etc.

You should have exchanged details at the scene and she admitted fault there and then, so if you have witnesses that can verify this, you should be okay, apart from one thing... You were effectively overtaking at a junction which is a bit of a no no and might cause you problems if the woman changes her story or her insurance company get difficult. Might go 50/50 as she should not have trusted a flash from another road user (flash is to warn of your presence, not to tell people you're giving way to them etc, but everyone does it...), but should have checked for herself.

This will change when her insurance co contacts yours with claims for medical bills, panel replacements, resprays, car repairs and statments that you were speeding and have admitted you were 100% to blame. With witnesses.

but hate dealing with insurance crap so hard work. GGGGRRRRRR

as long as your ok then thats all that matters..

no one wants to get there mint bike banged up as well.

She presumably didn't realise the traffic 'that mattered' was moving - as the other traffic was stopping for her.

Were it me and I had old CBR, I don't think I'd be claiming in such a case - especially with the worry of it sparking off a counter claim.
In this sort of situation it would be pretty hard for the car driver to see the bike, so not sure how a claim would go, regardless of what was said at the time.

I had a similar situation a while ago, but in the dark/wet - we actually both stopped with some space, however bizarrely the car then crept forward and nudged my wheel.

On shaky ground with this one I think. Overtaking at a junction, moving traffic. Traffic has to be moving very slowly for filtering to be reasonably acceptable and a reasonable speed is normally up to 15mph faster than the traffic you're filtering through. He's said he was doing 25mph so either he was filtering too fast or he's gonna have to admit he filtered past a junction which cars were passing at 10mph.

Personally, I'd call the woman tomorrow and reassure her I wasn't hurt, tell her there's no real damage to my bike and make doubly-sure she isn't going to claim, then fix my own bike and put it all down to experience.
If there's a chance she'll claim you'll have to go the insurance route but the best you'll get is 50/50 and you'll get hammered on your premiums next year.

Beat me to it.

Filtering past a junction is always a dodgy one, for reasons as have happened to you. I dont think you can expect people pulling out of a junction with stopped traffic to really be expecting a bike to come along, if your filtering in that kind of situation you need to be a bit more aware I'm afraid.

If she'd been pulling out on your right then I'd say you'd have a bit more of a chance, because she should of easily seen you coming, but with that drawing you did I'd expect an insurance company to contest that pretty strongly.

I wrapped my scotter bang on into some womans merc years ago who decided to pull a u-turn without indicating from a stationary position parked on the side of the road. I was flung off the bike and it smashed the plastics to pieces but it still rode alright.

She said, "oh my god it's my fault I should of indicated" and we exchanged insurance details. Few weeks later, got a letter from her insurance company trying to say it was my fault and I was speeding.

What I failed to realise, because my bike landed almost 15m away from the car and that's where we sorted the details out, she had 4 kids in the car which she'd just picked up from school and had stopped for some reason on this road.

One of the kids was also handicapped and after the nicey nice "it was my fault, i'll tell the insurance company that as well", she claimed for all 5 of them and got about £25,000 paid out. I got fuck all.

i understand all points but forgot a few things, i proberbly wasnt doing 25, more likely less, i had pulled infront of the car that flashed her a little before i hit her and she didnt see me as she was looking the other way and she pulled out pretty fast. and the traffice wasnt stationary it was moving maybe 10mph ?

also there is a speed camera just before it in a 30 zone so i know that i was well under 30 filtering past traffic,

havnt decided on what to do yet, but thanks for the advice so far

It always helps having an independant witness who can back up what happened, saves the other party trying to deny responsibility.

this, seriously.

Heads up I'm quite drunk, but:

I was in exactly this situation, expect the woman driver in question only mildly clipped me.

I bounced off etc, but we agreed not to take it to insurance.

This was on my 125, but honesly a jelly cbr is probably not worth much more (sorry!), but either way it's not worth it, she'll lie and cost you ££££ on your next premium!

Fix the damage or streetfighter and chalk it to experience dude! The only sensible way!

(be extra careful when filtering on junctions!!)

I agree with the others. This just proves the point why flashing headlights to let people out/give way is not a good idea. In fact the guy/girl who flashed their headlights is partly responsible for the accident but at the end of the day the car pulling out should only pull out when THEY are satified its safe to do so.

The problem is the filtering next to the junction.. Really you should have been filtering past that part of the road at crawling place and anticipated a car could be comming across in the gap so got a feeling in insurance terms it will be hard to prove she was 100% at fault.

Good luck mate and glad you are ok and hopefully a good learning lesson about filtering at approporate speeds and places.

Hope all gets sorted out for you.

Flashing of headlights is the official means of informing other road users that:

a. You have headlights.

b. You have a headlight switch.

c. They are connected.

They are not for informing other drivers:

a. Pull out onto the main road without looking for other traffic.

b. You think they're a cunt.

c. It's dark and they're driving with no lights, therefore b.

d. Any other excuse you can think of.

If you read your insurance policy guidelines that came with all your paperwork, I guarantee that it will say exchange names, addresses etc, DO NOT admit liability and contact your insurance company. If she contacts her insurance company they'll tell her not to admit liability and counter claim.

Do as said above, contact the woman and agree to end the matter there and then. If the insurance companies get involved, you'll be royally fucked over. Young person on a motor bike overtaking stationary/slow vehicles at a junction Thumbs Down

ok had the bike checked over by the insurance mechanic and an external examiner and its a total loss due to front end damage.

i decided to clim as the bike was unridable due to the amount needing doing to it and i didnt have the knowlage to fix it on my own.

The woman has admited fault and i had a witness on my side she did not.


so next week i take it i will get an offer back from the insurer ? and it will be pretty crap ?

the bikes value on the insurance is 1500,


do you normally refuse the 1st offer ?

or am i getting this mixed up with something else ?

Agreed, you probs went to the other side of the road to go round this car.
As far as insurance will be concerned, she would have seen traffic stop, and then proceeded.
Also... its poor obs on your side, especially at a junction.

Insurance isnt as simple, a woman pulled out on me xmas day, obviously at fault as my witness said she just pulled out, she counter claimed i was speeding on the wrong side of the road doing a wheelie?!
On a gs500...yea course Thumbs Down bloody insurance people... fyi its still not settled, this is xmas day 09, still got a claim for feb 08 going on too.. dont expect a weekly settlement!

the insurance people seem pretty confident they will have it sorted for next week,

my diagram may be a little off, its more of a little side road more than a main junction, the road i was trvaeling on i just passed a 30mph speed camera so i wasnt speeding and i didnt cross the other side of the road.

i was also passed said car before i hit her,

ill keep you updated, but i didnt have much other option to try and claim as its my only transport

well, insurance may be happy that it will finish in a week, but its unlikely it will as the other side will do anything to work you into the wrong!

yes ive got a long list of claims, im loved by insurance companies.

How did you get past the car without going on the otherside of the road... you could get in crap for following too close OR passing to close to a vehicle.

Either way, you could be looking at a long drawn out process, might be found at fault and be bikeless.... OR it could take a few more weeks, might accept it was 50/50 and both get shat all!

Personally i cant see you winning, junctions, stopped traffic, overtaking, not using obs correctly...

VERY difficult to see you through some car windows and it's not something you're actively looking for. If she has been flashed by a car then she will disregard that lane and focus on the other.

More than likely I'd expect 50/50?

I was in a very similar accident to this except, the driver thought she had done nothing wrong. I thought I was partly to blame for overtaking (filtering) past a junction and offered her 50:50.

It ended up going through insurance, and it went all in my favour, she was seen as completely at fault and me innocent.

I know in my heart of hearts, that me as the vulnerable road user, should have been more careful, and not to rely on car drivers to actually look where they are going or check for bikes when bikes are rarer than cars.
