PostPosted: 11:01 - 12 Apr 2010    Post subject: This vehicle is reversing. Updated with vidjo at last! Reply with quote

On my way into work this morning, following a delivery van. Just as he's about to pass a turn on the left, he suddenly indicates and brakes hard to a stop. I thought someone had pulled out on him, so I sit there and wait till he moves off again. Then he starts reversing! Tried getting out of the way while shouting a few whoa!s but it was too fast.

I watched as the forks that I spent battling with last bank holiday (changing fork oil) bend under the van and my mudguard break into bits.

The guy jumped out and was very apologetic and I was pretty calm and we start swapping details. But when he's on the phone to his boss he's saying that he braked hard and I hit him. I tap him on the shoulder and tell him, no, you reversed into me.

We get the vehicles off the road and I try to make sure that he realises he's made the mistake, but he's all sort of "I'm not sure, whatever you say, I don't know" so I really get the feeling he's going to deny responsibility.

After talking to my insurers, it seems that as there were no witnesses, it would probably go 50/50, so I'd end up losing my no claims, plus paying for the damage to my bike, and all the inconvenience of having the bike off the road.

So.... it was a damn good job I just happened to have mounted the camera on the bike before I left this morning! Yay! Very Happy

The video shows it all, him braking hard and late and then reversing straight into me.... Ha! Deny that, you wanker!

Sent it to the insurers who looked at it and think it's 'brilliant'. Smile Oddly though, they said that I'm only the second person to have video to backup my claim in a no-witnesses accident, which surprised me. Confused

I won't put the vid up until it's all sorted, but here's a pic of the aftermath;

https://www.planetash.net/bcf/van1.jpg

You can see the tyre mark showing on the road where he pushed me back.

Hopefully should have a courtesy bike delivered tomorrow. I'm hoping it'll be a Street Triple R, or a CBR100R, or something similar... but it'll probably be a CG...

Anyway, boy am I glad I chose this morning to put the camera on! Going to be a permanent fixture from now on, I think. Plus I've got another cam coming this week, so that'll go on the back for when someone rear ends me. Very Happy

Congrats man, My heart was sinking when you said no witnesses and he was denying it. You brightened up my day with the good news about the camera Smile
Nice bike =]

How much was the camera and how hard was it to fit?

This is where louder pipes save fork stantions, that picture should be more than enough evidence that he reversed over your but insurance companies are cunts, it will take them serveral years to tell you it will go 50/50

I can't see how you hitting a van would end up going under his bumper.

It is my dream to have someone flat out lie about an accident you have video evidence on, I would love to let it go all the way to court have them purger themselves then you wack the video on.

Yes, I thought I'd tease a little first before mentioning the cam. Wink

Thanks! It was 29.99, and one of those similar in the Keychain camera thread (it's an MD80 type), but I've seen them go for anywhere between £8 and £50. I think there are 3 types, the 'proper' ones, copies that are ok (like mine) and other copies that seem to have a lot of problems.

Edit: It;s one of these:
https://www.gamedepot4u.com/images/mini%20dv/mini-dv-md80.jpg

With a plastic body, not the aluminum body type, but not the sort with the built in memory though.

As for mounting, I just cut a strip off some ally sheeting I had, drilled a hole at one end and screwed that to a spare hole on the brake balancer underneath the headlights. Bent it into shape with pliers, then I just rubberbanded the camera to the strip.

It really, really needs a rubber cushion on there somewhere tho as a lot of the video is quite wobbly, especially when I'm caning it Smile

I think it'll be ok, because even if the pic isn't good enough, they still have the video... Wink

I forgot to mention the ironic bit, the company whose van it is, is our main competitor! Laughing

As soon as they've paid up I certainly will. I'd like to now, but I don't want to risk jeopardizing the claim... just in case.

Yeah but the problem with such videos is if a cop stops you and you were ahem riding spiritedly = bg trouble. And you can't just password protect it either as an anti terrorism law exists that says you give us the password or 12 months in prison.

You might also have had some recourse because the van is on top of your wheel in that photo... how can a bike lift up the back of a van unless the van is moving backwards under power?

Good job you have video evidence though!

Haha that'd be awesome.

And that second bit is awesome.

You should get a bonus from your employer for putting a work van out of the road Laughing Laughing

BTW I would put money on they would write than off.

Could easily be bew forks and new wheel, new tyre and mudgaurd. Plus 4 hours labour. Easily +£1500 from a main dealer.

Not really he is the one with a smashed up bike.

That's true, but the good thing is I was doubtful of the integrity of the forks from my off last year, and it could probably do with new ones anyway.

I noticed it when I was putting them back on after renewing the fork oil on the last bank holiday. They came off ok, but when I went to put it all back together nothing seemed to sit right.. the wheel didn't appear to have room to go in between and it was all a bit of mare. Even the fork brace wouldn't fit at first and had to be forced back on. I think the wheel was slightly out too, as the tyre pressure is always slowly going down. With a new front end (which is what I'm assuming I'll get at the moment) it should sort all that out.

So it might actually work out for the better in the end! Thumbs Up Very Happy

Good point, that could be interesting. If they do offer that, and the option to keep the bike I'd probably go for it. Do the work myself and have lots of money to spend on more shiny things Smile

and drugs...and drink... and women...

Hi

I agree with Chris-red. I would expect bent wheel, forks and yokes along with wrecked mudguard. Bike is probably worth £1500 tops (early Bandit, could be worth less easily), so would be written off at £1k or less damage (~2/3 the value). Complete forks amount to £474 each new.

All the best

Keith

Dam! from the looks of that picture and damage to the vehicles any investigator should be able to see it was the vans at fault for reversing.

The forks look like they are bent the "wrong" way under the van. All the specific damage and the pictures I would've thought that the tire mark on the road would seal the deal in favour of you, even without the video evidence.

Stranger things have happened, an incident I remember is a BMW hit a CBR once on a double parked road, side stands are on the left, the BMW driver ducked into the space where the CBR was and rammed it into a shop front.

The BMW driver immediately claimed that the CBR fell infront of his car, even though the impact trajectory wasn't right, and it leaned to the left too so couldn't possibly have fallen over lest a hurricane force wind hit the CBR.

The CBR pilot even with an engineer who attested the trajectory of the CBR couldn't have been the way it had been if his bike had fallen over lost. He had to pay the insurance for the damage to the BMW, the shop front and the car it was parked next to and his insurance premium had an extra 00 when it came to renewal time.
