Well after getting my bike back on the road last week my efforts were destroyed today by a London bus driver, he pulled out of a bus stop into me and my bike ended up sandwiched between his bus the road and some poor bastards car. Amazingly I am fine apart from a sore ankle but I fear my bike is a gonner, damage as far as I can tell so far is
fucked exhaust
dented swing arm
4 indicators
mirror
screen
front fairing
side fairings
lower fairings
rear fairings
bent forks (which I replaced only last week)
engine casing (oil all over the road)
brake lever
bar end
hole in jacket
hole in jeans
scratched helmet

my insurance is TFT so I also had to pay to have the bike recovered which entailed £104 and waiting at the side of the road for 4 hours, luckily its nice and warm outside Evil or Very Mad
I have heard nightmare stories about claiming from London transport, anybody experience this? bus driver claimed it wasn't his fault however the fact that my bike was behind his front wheel would suggest otherwise, does the fact that my bike then hit somebodies car affect my insurance?
Also, any ideas on getting my wife to come round to the fact that I will get another bike appreciated!

the bus wasn't moving when I went past it, neither did it indicate but thanks for the helpful advice

Did police attend? You've been injured so it should be reported to them if it hasn't already.

Did you get any witness details (ie. the person whose car you hit)?

What did they say about the incident?

Find out which bus garage that route runs from/to and ring them ASAP to preserve the CCTV. It's unlikely to have anything pointing at the off-side of the bus, but you never know, sometimes the interior cameras catch things happening outside.

Get your account written down now before you forget it, with diagrams.

Did you take photos? and did you get the car driver's details.

If this incident turns out to be the bus driver's fault, then the bus company's insurance will pay out for your bike, your injuries AND the damage to the poor bloke's car as well.

If you have the details of the car driver, who's side was he on? who did he believe was at fault? because he will be a valuable witness, as he, although involved in the accident, is still an independent witness. (he doesn't give a shyte which of you pays out for him).

Photos will do a world of good in this situation, because if you were behind his front wheel you were right in his blindspot as he pulled out, meaning he didn't check.

Was traffic stationary? Filtering accidents are easiest to prove if traffic is stationary as you are filtering Perfectly legally.

Get in touch with your insurance company asap, and tell them everything, they might get you booked in to go and see a doctor so you can claim for your ankle. And take photos of, and keep all damaged items until the claim is over.

There should be a rearward facing camera above the cab window on the outside of the bus, all our newer buses have one because many drivers play the old game of "wait untill the bus indicates right, then overtake at warp speed"

As far as i'm aware (being a yorkshire man) the majority, if not all buses in london are under 3 years old... engine emmisions reasons or something...

Hopefully that buses cctv had it's hard drive fitted that day Thumbs Up

Let me through... I'm a bus driver.... no really I am.

our buses have 14 cameras in and around them, so there's always something caught somewhere.

Was the bus sitting in the bus stop properly? Did the driver give you a card with his details on it? Did he take photos (as we all have to carry an accident camera with us, and report all accidents within 6 hours).

You said that the bus wasn't moving, if they have cctv to show that then unfortunately you are to blame because you hit a stationary vehicle.... also whether the bus driver is at fault or not.... you'll have a long fight on your hands trying to get a single penny out of them.

Driver took photos, bus wasn't moving as I started to overtake then pulled out as I was alongside giving me nowhere to go. The other traffic was stationary. Police attended the accident and took statements. So I guess I have a long wait till I can get on two wheels again Neutral

Thanks Pete that is an unbelievably kind offer, I'll ask the insurance company if its possible to swap my insurance, a quick internet check revealed that fully comp on a Diversion is cheaper than TFT on the thundercat.

It's SORN'ed right now but I was planning to tax it so we can sort that. Also needs a new battery but I'll get one of those too since it needs it anyway. It's nowt special but it'll get you a-b. I'll go find the documents.

it appears my insurance doesn't include legal cover either so if anyone can recommend a no win no fee type firm that would be most kind. although I'm unlikely to be claiming for injury so I presume that will make it more difficult Question

their advice was that they can present the case for me but as its against metroline a legal team would offer more bite and would be better at resolving the filtering issue

he didn't indicate until he moved, and relentless please go be helpful elsewhere, I have watched my bike die on top of a rather shitty week all round, getting tut tutted by a large man on a childs bike who shits in gardens may well tip me over the edge Thumbs Up

As a person who still remembers his bus rides to school I still remember in acute detail lots of occasions and oddities.

I know for a fact just by looking at my drivers, that they accelorate, close door, indicate, then look at mirrors and then where they are going. Rolling Eyes

I don't see anything wrong in what you did, if it wasn't you it could have just as easily been someone on a push bike, the bus driver should have checked properly.

In terms of legal stuff White Dalton send me tons of leaflets about no win no fee bike claims; I can't say how good they are, but their testimonials page seems to speak for them.

another london Biker, and if we didn't filter we would get no where.
I don't seee what you did was wrong ..the bus was stationary as you overtook (albeit) filtering between traffic.

very common to have to pass buses, as bus lanes still start/stop suddenly and some do exclude motorcycles.

I would normally prefer to be in lane 2 (outside ) to overtake / pass stationary traffic , but have been in this position many times.

Bus driver by your accounts Signalled, manouvered THEN Mirrored.

naughty, naughty,

(if it had been a cycle may have been much more serious, so they HAVE to check, even if it says 'let the bus go first' )

would suggest that a big company will drag itself to settlement with one individual,

but get a pro dealing with it (no win no fee) and in a clear cut case they will fold....( most likely..)
