Started the proverbial ball rolling, Kris. Thanks man.
Acemastr, based on your comment, i should pay a higher premium to stop others paying a higher premium, which doesn't make sense.
I didn't break any bones, nor had time off work, and the insurance company dealt with the 'disposal' of the bike, and paid out quite speedily. However, i didn't take any time off work, because I already am on a warning for time off from an earlier accident where i had cracked ribs - i felt under the circumstances i couldn't take time off. I was working everyday after the accident whilst taking 240mg of codeine and 4000mg of paracetamol daily for the whiplash and hematoma i had suffered (which i doubt is a hematoma as apparantly it's only supposed to last 6 weeks, this has been going on for months and still causes me pain). My job somewhat changed at work to accommodate the fact i couldn't carry out my duty, and as for the disposal of the bike, my insurance went from £104 fully comp on a 500, to like £214 for the same make/model. Why shouldn't I pursue this? Because i hadn't broken a bone? meh.
As for suffering hardship, the guy couldn't apologize enough for running into me, he went from parked - to knocking someone who was on the road, down because he didn't indicate, use his mirror, or any form of common sense. His reason for not signaling btw, was because he DID use his mirrors, but didn't see anyone, so he would have felt like a tit for using them when no one can see. That's not what he told the insurance company. He told them that he signaled and mirrored, and at no point was i there, implying i was speeding. I was doing about 4mph because being behind him, i had to stop in the road while he pulled up to 'park'.
His lying has quite simply without a matter of doubt in my mind caused this liability matter to be ongoing. Had he have told the truth to his insurer, i wouldn't have even considered this option. He lied, and i get stiffed for it, why should he fight for his vehicle to have his dent pulled out (he was on third party), and i have to pay higher premiums because he didn't see me?
I think you can put that down as hardship. ____________________ If everything seems under control, you're just not going fast enough. |

Unfortunately unless there are witnesses then most people tend to lie to avoid getting a blame mark put on their insurance record. They know they shouldn't do it, they know it's against the law, but they don't tend to care.
I forget who posted it on here but a van stopped in the middle of the road and reversed into the rider behind. Tried to claim the rider didn't stop.
The biker won the case, but only because he had video evidence.
Helmet cameras can be useful

They got me quite A lot of cash and didn't take any off me. They all recuperate their costs from the courts not you these days, new legislation a few years back.
Also White Dalton is a motorcycle solicitors firm, they all ride too. ____________________
