My mate insists that if you get stopped with no MOT and TAX, you also get points on your license, (for no insurance - we've established that "No MOT" and "No Tax" are not endorsable offences), but he says that it's a "techincal offence" and you get points even if you have a valid insurance certificate.
I've told him that it is my belief that although you might not be covered in an accident you cannot get prosicuted for no insurance.

So, basicaly, if you have a valid insurance certificate, but no MOT or TAX and no other offences have been committed, you will not get any points on your license if stopped?
I'm going to drive the motor to a pre-booked MOT so I can tax it. My mate seems to think that , if I get stopped I will be endorsed for not tecnicaly having insurance.
I'm sure I knew the answer to this already but my mate's just not having any of it
Even if I wasn't going to a pre-booked MOT, I wouldn't be too bothered if the car was crushed anyway - might save me the problem if it fails the MOT  |

Hi
You will likely get a months grace before they will offer to take a bribe instead of taking you to court for not declaring SORN. However there is no grace for using an untaxed car on the road (just the exemption for pre approved MOT stuff).
There is a 5 day exemption for not displaying a tax disk, but only if you have already bought one online before the previous one expired.

Driving without an MOT
If your vehicle is at least three years old, it needs to pass an MOT test before it can be considered roadworthy. Driving a vehicle that has not successfully passed an MOT test can land you a fine, but will not usually result in penalty points. ____________________ My YouTube Channel

I'm just concered about the insurance "thing". If I get 6 or more points it's bye bye license, (only until Feb 22 when some speeding endorsmets run out but it's bound to give the insurance an excuse to penalise me.
My policy is current and up to date though so I'm sure there's no chance of that.

The only offence that I can think off off the top of my head where you might suffer a consequential offence of no insurance despite producing a certificate is if you were found to be riding/driving not within the conditions imposed on your license (i.e if you didn't have a license for that vehicle). This is because insurance policies have the wording 'provided that the insured holds or has held and is not disqualified from holding a license'.

Yes, but as Kickstart rightly says above, if you have a policy, in your name, for that vehicle, then you have third party insurance. End of story - the insurance company cannot get out of that no matter how they word their policies.
It makes sense when you think about it. Anyone who's ever had to deal with an insurance company knows the first thing they do is try to find a way to get out of paying. If they weren't forced to provide the legal minimum cover, the whole system would fall apart. You'd be hit by someone doing 35 in a 30, and be told by their insurers "Sorry, we only insure him while he's driving within the law - he was speeding so he's not covered"
Yes, they have the option of going back to the insured person and trying to recover whatever they had to pay out, but that's a seperate issue which doesn't affect in the slightest whether or not the person was insured as far as the law is concerned. ____________________ Current Bikes: 1983 Honda VF400FD / 2003 Honda VT750 Shadow
