just so its nt a TL/DR

got caught, sent paperwork back......2 months later and still no word from them on how much it is or points........


So how long do they have to actually fine me?

6 Months IIRC.

Actually that's for conviction after receiving NIP - have you been convicted of the offence?

What was the speed alleged? was it a camera or a roadside stop?

It was 63 in a 50 on the M25 roadworks at 1am on a sunday morning by those average speed check camera systems.

What paperwork?

They'll have sent a section 172 demand to identify the driver. You have 28 days to respond. Are you sure that they received your response?

You (well, the registered keeper) should also have received a Notice of Intended Prosecution within 14 days of the alleged offence.

"within fourteen days of the commission of the offence a notice of the intended prosecution specifying the nature of the alleged offence and the time and place where it is alleged to have been committed, was—

(ii)in the case of any other offence, served on him or on the person, if any, registered as the keeper of the vehicle at the time of the commission of the offence."

Now, they may claim that the Section 172 was also a NIP, but you could have a laugh and try arguing that it should explicitly state an intent to prosecute, not just allege an offence, and that it should "specify" the nature of the alleged offence. Check what they sent you carefully, they may have bungled it.

Oh, and yes, 6 months from the date of the offence.

All this received and sent back


so outcome is 6 months apparantly, that sucks, bet they'd complain if i took 6 months to pay!

OK, but did you receive a NIP as well? If not, what was the wording on the Section 172 demand?

IIRC from a run in with the incompetent CPS, it's 6 months to begin proceedings (ie commence prosecution). The to and fro can then go on ad nauseum (as it did with me, ending in the case thrown out by magistrates when they realised that the CPS had nothing and the police had managed to destroy the only evidence that ironically proved my innocence).

Did you keep copies and get proof of posting?
You may have a problem if they say they didn't get it, S172 failure to furnish details.
Or they may have lost it.
You should have received a COFP by now.

Note that I believe the CPS has six months to pass the details to the courts.
So it may be a bit longer for an actual court date if it's going that way.

Err, because you broke the law and were caught?

You may be offered a 'bribe' to plead guilty, bypassing the normal legal process (fixed penalty), but it's that legal process you need to worry about time wise as far as I know.

You haven't made it clear about the NIP - but a 'was it you driving' just confirms they have the correct person to then charge.

It does make me laugh when you see people fly past in the average speed camera zone in roadworks, then slam the brakes on when approaching a camera, and speed off again when past it! Laughing Do they not understand the words AVERAGE SPEED!?

Also, it doesn't matter than no one was working on the roadworks at the time, or what time of the day it was. The conditions of the road (ie: the roadworks) mean the limit is there for a reason.

Contraflow, cones in road, unfinished surface etc....

Shouldn't go to court, 63 in a 50 is within guidelines for COFP (Conditional offer of Fixed penalty) £60 + 3 points.

Sometimes, the initial request for driver details, (s172 request) doubles as the NIP (notice of Intended prosecution).

Either way, I would have thought you would have a COFP by now. Did you get proof of posting when you sent the form back?
