Sorry to hear it, go and get checked out for God's sake. That knee looks like it's about to pop.

You appear to have damaged your English comprehension skills in the accident. What happened exactly?

Bike looks not too bad, but any damage is pretty gutting. Forks look twisted in the yolks, loosen off the clamps and they should pop back straight again.

Are your knees always that knobbly, or is that REALLY REALLY swollen?

IIRC They have to prove you were speeding (You don't have to prove you weren't), so you either (foolishly) admitted to it, or you've been banged to rights and aren't saying. Wink

I would get that knee checked out if I were you.

And I would happily attend the driver improvement course and learn what I could from it.

I had to do one of those courses when I crashed my first car almost 6 years ago, it was 2 days of talking about crashes and then driving like learners in a fiesta. It was pretty useless for me though as I had only just passed my test.

I'm sorry for your loss and all that, but you don't "have" to do anything.

You're being offered a choice to do it as an alternative to prosecution. The burden of proof is entirely on the Police and CPS. If you believe that there's a reasonable doubt that you were speeding then feel free to tell them to shove their course up their arse and to either prosecute you or GTFO.

well the police said if i dont do the course i got to go court for dangerous driving and 3 points and £60 quid fine , i would rather do the course.

Unless they can prove that you were speeding (beyond reasonable doubt?), or you admit to it, there is naff all they can do, all taking you to court will do is cost them a bunch of money to prove nothing.

Don't let the cops bully you into accepting the course, they want you to make their job easier.

Firstly, it is very unlikely they would obtain a conviction for dangerous driving, but in any case a dangerous driving conviction is considerably more than 3 points and 60 quid.

They probably meant careless driving which is the lesser offence although easier to prove still requires decent evidence.

The burden of proof is on the Police to prove that you were either exceeding the speed limit or your speed was excessive for the conditions, and unless your riding was witnessed by a traffic cop immidiately prior to the crash who is allowed to give expert evidence of opinion.

Unless the Police carried out a full accident investigation (which is unlikely unless there was a fatality) then they will have no evidence of excess speed, and although witnesses may have stated that "You appeared" to be travelling quickly or fast, that initself is insufficient.

So, you are well within your rights to decline the improver course and ask them on what grounds and what evidence they propose to disclose, and then plead not guilty.

If they do not have the evidence, then they cannot act as judge and jury and decide that you will attend a course without you knowing what the evidence is as attending the course is virtually an admission of your guilt which can be used against you and you still end up with a fine (the cost of the course) albeit you don't get any points.

Is attempting to prosecute people involved in accidents commonplace now then?

You can always change your mind. It largely depends on what you were daft enough to admit to, or rather what the police can credibly convince a court that you admitted to.

I guess you know it now, but never admit to any offence at the time - there's plenty of opportunity to plead guilty if you are prosecuted - and think twice, and then again for luck, before making any statement about what happened, even if you think it might help you.

However, since this happened because you demonstrably were riding too fast for either the conditions or your judgement (or both) then I say all this with the strong suspicion that you were in fact riding like a nobber and would probably benefit from a course in how to avoid killing yourself and smashing up other people's vehicles.
