anyone with a hint of leagal knowlede willing to help without charging me £60 per hr?

claimant has sent me an N1 Claim form and particulars of claim directly. Relating to an RTA 2 years ago where i was at fault (dick).
Its sent and directed at me and not my insurer. am i right in assuming i'll be paying up to 1£15000 out of my own money (or the baby fund?). or am i supposed to forward this on to my insurer? whom i'm yet to speak to on the sub ject.

doomed either way so give me the worst, if your in the know, much appreciated.

Forward it on to your insurer; they should cover it.
However, they do usually specify you should inform them of an accident at the time.

i do have fully comp insurance, and did then.

This is definitely one for T.C.

First up though, does the claimant have witnesses, or an admission of fault by you?

Oh dear; sounds like they've found themselves a bit short of cash and you're the one capable of sorting them out.

As far as I know, if there is a claim, it should all go through your insurance.
It could slightly up your next insurance because the claim's now worth more, but shouldn't be a big thing; so shouldn't be anything for you to get worried about.

I don't have any expertise in this area at all, but my guess is it's one of these "No Win No Fee" wankers, just forward to your insurers at the timeof the claim, its thier problem not yours.

You pay insurance for these kind of events.

Thanks.

As a service engineer i clock about 50000 miles a year in that sodding van. and it just took that 2 yard mistake 2 years ago to place my neck (wallet) on the guillotine now.

Who decides two years later that they're injured?

i think its just taken this long for things to be prepared. The medical reports date soon after incident.

short version of this is your insurance company will have settled it, the 'victim' will be unhappy with the amount they've got and are now trying to sue you personally for more, seen a couple of these forward it to your insurance company who will then inform them via the other parties insurance that they agreed to full and final settlement of the claim when they accepted there insurance companies offer and that will be pretty much the end of it

First mate STOP WORRYING. You had insurance, that hasn't changed and they are the ones who will have to pay any compensation. Make copies of the letters and forward them on to your insurers of the time.

So what was it? Other party trying to claim more cash or the unsettled personal injury claim from a couple of years ago?

Before you tar everyone with the same brush, get your facts right.

As you have just demonstrated, you have no expertise in this area, in fact you have no expertise period.

to the OP.

In personal injury, claimants are subject to what is called statute of limitation.

What this means is that anyone who is injured as a result of someone elses misfortune or negligence, has 3 years from date of injury or date of knowledge (whichever is the sooner) to issue proceedings against the third party for the injuries they sustained.

The exception to this statute of limitation, are juveniles and persons incapable of looking after their own affairs (brain injury cases), but for everyone else, if proceedings are not issued by limitation date on year 3, then the case becomes time barred and is struck out.

That said, 99% of cases are settled without the need to issue proceedings.

Form N1 is the standard letter of claim, and all you need to do is simply pass it to your insurance company and this applies with any future correspondence you receive in the future.

The letter is addressed to you, because although your insurers will deal with it, you still remain the third party defendant.
