anyone with a hint of leagal knowlede willing to help without charging me £60 per hr?
claimant has sent me an N1 Claim form and particulars of claim directly. Relating to an RTA 2 years ago where i was at fault (dick).
Its sent and directed at me and not my insurer. am i right in assuming i'll be paying up to 1£15000 out of my own money (or the baby fund?). or am i supposed to forward this on to my insurer? whom i'm yet to speak to on the sub ject.

First up though, does the claimant have witnesses, or an admission of fault by you? ____________________ Biking is 1/20th as dangerous as horse riding.

First mate STOP WORRYING. You had insurance, that hasn't changed and they are the ones who will have to pay any compensation. Make copies of the letters and forward them on to your insurers of the time. ____________________ a.k.a 'Geri'

cheers everyone, will be getting on the blower to insurance in the morn.
just glad i didn't spend to much at NEC, and as of january all the points i racked up as a teenager are finally a thing of the past (can 't belive they take them into account for 5 groanworthy years!) ____________________ Chase my Witch up, Catch my Snitch up.

Before you tar everyone with the same brush, get your facts right.
As you have just demonstrated, you have no expertise in this area, in fact you have no expertise period.
to the OP.
In personal injury, claimants are subject to what is called statute of limitation.
What this means is that anyone who is injured as a result of someone elses misfortune or negligence, has 3 years from date of injury or date of knowledge (whichever is the sooner) to issue proceedings against the third party for the injuries they sustained.
The exception to this statute of limitation, are juveniles and persons incapable of looking after their own affairs (brain injury cases), but for everyone else, if proceedings are not issued by limitation date on year 3, then the case becomes time barred and is struck out.
That said, 99% of cases are settled without the need to issue proceedings.
Form N1 is the standard letter of claim, and all you need to do is simply pass it to your insurance company and this applies with any future correspondence you receive in the future.
The letter is addressed to you, because although your insurers will deal with it, you still remain the third party defendant. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |
