Long story short:-

Bought hardware item from store. (Xbox 360 gaming headset)
Item is cannot be used unless an addon is purchased. (Action Cable cos i use hdmi)
This is only found out buy opening the box and reading the manual.
There is no mention of this on the packaging.
Returned to store, request refund.
Refund refused as I had opened the box, credit note instead.

/me is a bit peeved and is sending a complaint email.

Legality of this?

Cheers

Direct quote from MoneySaver website:
"Many of us have bought something only to later decide that it's unsuitable or unneeded. Yet shops are under no obligation to take your goods back, just because you've changed your mind, only when they're faulty.

The exceptions to this are when buying on the internet, mail order or financial agreements, when you do often have cancellation rights.

Yet even when you don't have rights plenty of companies do still give refunds. These are mainly high-street stores with returns policies allowing you to simply take back whatever you want within a set timeframe. You're less likely to be able to change your mind for a service contract that's started though.

These goodwill polices have encouraged more and more customers to expect this as a right, even though it doesn't always apply.

This doesn't mean you can't ask though. Shops would rather keep customers happy than be sticklers for these rules. They consider all customers to be potential clients who will use their services or buy their products again and again".

I'd be tempted to write to Head Office, and state there was nothing written on the packaging and the salesperson in the shop didn't have enough technical knowledge about said product...so you didn't know the correct lead was there or not...is there any possibility that you could exchange for the correct product?? Or get a full refund rather than the credit note.

My general rule of thumb is: you don't know unless you ask...! Thumbs Up

So can this item be used without any add on's via other connection methods ???

Did you advised staff, how you wanted to connect it.
If yes, did they say it was Ok?

If you didn't ask, then I think they may be within their rights. As you have changed your mind.
Yes, I know it does not state other items need if connected by HDMI, but if it works via other connections methods.
Then if unsure you should be asking...

BTW. I hate the way that manufacture's are using packaging that does not allow you access to product without destroying.. Twisted Evil

I can be used without any add-ons as long as you are connecting your xbox360/xbox360 slim to a display using the standard video port/cable

using the standard port/cable blocks off the HDMI port.

Nopes, didnt speak to the staff about using HDMI considering every new xbox360 that is sold has a HDMI port as standard.
And the fact the name of the product is "EX-05 WIRED STEREO HEADSET FOR XBOX 360"

Im hoping some bright spark might be able to provide a "consumer rights" thingamabob that i can state in my email to Game.

So just how does this connect to a xbox then.

Sorry don't have one....

I would copy your email off, to the manufacture as well. Pointing out that, they should list using HDMI port, requires additonal purchase on the pack.

I would try going back again and asking to speak to the manager and point out that. You bought it in good faith, but that using the HDMI port, as the connection, means that you cannot use the item. And that you don't want to spend anymore cash on a headset.
Adding that the only way you found this out is by opening the pack to read the manual.
Something his/her staff should have advised you on when the item was purchased.

This is on the basis that the item is "Unfit for purpose"

With standard video cable plugged in, notice the blockage of HDMI

Take plastic casing off the video cable, allows you to plug both video cable and hdmi in at the same time.

Having spent Christmas day un-boxing various 'toys' with varying levels of tape, wire, wire and plastic strips, and now screws !! (Hold on Hannah I'll just pop to the garage for a phillips).

I'm beginning to think packaging designers are feckin barstewards.

Why would the cable block the HDMI hole on purpose. Thats just not cricket.

Don't suppose you are on about the Turtle Beach x12? I bought this today and it says an adapter is required if using hdmi on the very bottom of the box.
