I got knocked off one of my bikes back at the start of November, the third-party admitted responsibility and the bike was wrote off followed by being paid out for its agreed value.
Since then the issue of my other losses such as bike gear/earnings/recovery costs plus injures have been dragging on since due to waiting for a medical report on my injures to my back and legs, MCE and there solicitors fletchers have now sent me to 3 medical appointments this year each time after traveling across London to the clinic they sent me to l have found it shut which now after the third time l,ve had enough of especially as MCE have not bothered to tell me that the appointments had been canceled.

There is absolutely nothing to stop you instructing new solicitors.
All that happens is that you will be asked to sign a letter of authority stating that you no longer wish your current solicitor to represent you.
The new solicitor will then request the file from your current firm and also provide an undertaking to pay their reasonable costs when the case is settled.
Have you made a full recovery? The reason I ask is that apart from being sent to a number of failed appointments, you have been asked to attend to see the medical expert very early after your crash, particularly if you are still experiencing problems.
A personal injury case does not settle overnight. A simple case is going to take around a minimum of 12 months providing you have made a full recovery, on average nearer 18 months, and the mosre severe the injuries the longer the case will take.
Usually if you have been asked to attend the medical within 6 months of the date of injury, that is usually proof that your solicitor is trying to settle early and with a severe undervaluation so that they get their fees paid rather than look after your interests.
The other side will also put up legal arguments to try and reduce the valuation of the claim as well as mitigate some of their losses, and so a schedule of losses can (the total value of the claim) can take a while to put together bearing in mind it is not just about your injuries, damaged kit and the like, but also loss of earnings, out of pocket expenses, travel costs, maybe care costs during your recovery and, and, and.

As far as i can tell Fletchers is just another floor of the MCE building, each floor is probably registered at companies house.
They sent me to Harley street, to possibly the most crooked doctor i have ever met. During the brief consultation i was fairly honest about my injuries. He was literally putting words (or injuries) into my mouth. He must have been on some kind of commission, the more injuries he finds the more he gets on top of his base fee...
Technically i don't see any reason you could not switch from fletchers to someone competent..

Be careful if you do get new solicitors as MCE will rape you for the cost of the time of your current ones.

My experience with MCE and Fletchers was reasonable with respect to two non-fault accidents I had.
It got there in the end, but it took bloody ages, medical appointment was a joke and I had to persist with chase up emails.
First thing is to be realistic, do you really expect a fast and hassle free process from the average insurance company or solicitor?
The key is to keep chasing them up with emails, find out at who at Fletchers is handling your case and get their email address. If you don't get an acknowledgement to your chase email after a day or two, send it again.
Also, insist on having electronic copies of forms and letters emailed to you if they don't do it automatically. This way, you can respond to letters instantly, print forms, fill them out, scan them in and email it back. Again, send the email again if you don't get a acknowledgement after a reasonable amount of time. |

Just jumping in here, first post ever so I apologise.
I've an open claim going on, car pulled a u-turn on me and wrote off my Bonnie, big mess. MCE assigned Fletchers and I just went with it, however my case handler went on holiday, not really a problem I know, but she didn't pass my case on to anyone else. I rang for days trying to get through to someone to talk about my case but just kept getting an answer phone or a receptionists "I'll get someone to call you back" I never received a call back.
In the end I changed solicitors, I'm sacrificing 25% of my compensation but I don't really care, it's now being dealt with professionals and I'm far more comfortable. I got a call from my case handler a day later asking why I was changing solicitors my response was 'how was your holiday?' She hung up on me.
Oh just to show you what kind of people Fletcher's are, it's been over a week and they still haven't forwarded on my case file to my new solicitors.
Picking up a new bike tomorrow, just going to have fun and forget about the case then. |
