Hi guys.

Bad news. My insurers are cancelling my insurance because I am unable to provide a photocopy of my photocard.

I lost my card in my wallet a few weeks ago and I have explained this to my insurers and that I have ordered a new card. I have provided a copy of my paper counterpart and my pass certificates explaining what has happened.

The thing is, the insurer has lied to me. I have 4 years no claims and they stated at the time of purchase that I did not need to provide a copy of my licence because I have no claims.

They have sent me three letters (I recieved another two today) and it's saying that they're going to cancel my insurance in 7 days.

I have emailed them a copy of their emaill which is shown here with the relevant info highlighted in a box in red.

The first I knew about having to provide a copy of my licence was when I recieved a letter this week requesting this. I was mislead into believing that I didn't require copies of my licence then I think it wouldn't be unreasonable to wait the 3 weeks (15 working days) that the DVLA claim to take to send out their replacement photocards.

I am more than happy to send copies of my licence as soon as it arrives. I am just worried that my insurance will be cancelled before I get the oppertunity.

Basically these scum aren't budging and don't seem to understand that I am riding legally and that I cannot possibly get a hold of a photocard within the time they have given me and that they are a bunch of lying bastards.

I need some advice because I don't know what to do. I don't want my insurance cancelled.

Don't email as it could be days before they even look at it. Ring up and ask for a complaints/customer relations department.

Tell them you wish to make a formal complaint. Outline the complaint. This will kick in the formal complaints procedure and should buy you some more time at least. Keep notes of names and times of people you speak to.

This. Don't be afraid to kick up a fuss and keep on at them. They tend not to do much unless you become a nuisance.

AND DO NOT BE FOBBED OFF.

Keep at it until you speak to a supervisor or an underwriter.

The frontline will probably tell you there is nothing you can do without the docs they request.
Dp NOT accept frontline staff as last word.
Inform whoever you speak to you will refer the matter to the ombudsman.
Write to the ombudsman and ask for advice.

Check out if you can get cover elsewhere and cancel with the idiots you are with now.
You will be wanting All monies back minus any days on cover. Fuck thier cancelation costs, they are in breach.

If you do call, when the frontline mong insists that Computer Says No, be sure to ask for their full name so that you can get it right on the complaint to the FOS.

Try to stay calm, you'll win it in the end, but be resolute and keep hammering on them being "unreasonable".

And I agree, best way to punish them would be to get a full refund issued, no "arrangement fee", no pro-rata charge.

Have you sent them proof of your NCB?

Prehaps that is why they keep asking for the rest.

But as others have said raise a complaint. Do it via both phone to get it logged quickly and follow up with a email for proof of complaint.

All they're saying in the attachment you included in the OP is that if you don't have NCB, you'll have to send them a copy of your licence. They don't say that you don't have to do this if you have NCB.

Ruh roh. It looks like their core business is actually mugging people with extra charges.

Given the circumstances, I'd be tempted to just email and say "No, you don't get to cancel as the policy is void due to your misrepresentation. Refund the entire amount paid, if you withhold one penny I'll be seeing you at the FOS." then take it from there.

This is just a wee update to let you know how I have got on with this. I have recieved an e-mail saying that they are now extending the time to provide my licence by another 14 days. This should be enough time to provide what they need.

My biggest concern now is the DVLA mucking something up. I sent them a letter telling them not to change the date 2 years forward of my pass date if they remove my restriction code. I just hope they listen to it because these seem like the sort of insurers that wouldn't understand this.

Fingers crossed I get my photocard on time.

It doesn't end.

It seems that the DVLA have totally disregarded my letter telling them not to move my pass date two years forward if they were going to remove the restriction code.

Now I'm in a situation where I will have to explain this and I have also lost 2 years of bike licence experience.

The only thing I have going for me is that I passed at age 17, so the pass date is at age 19, which shows it was impossible for me to direct access at this age. I must have done A2.

What a joke.

Express pissfarted about sending me my cover note, but I wanted to tax the bike.

e-mailed asking them to e-mail my cover note (which other insurers sent me as a matter of course), so I could print it out, nothing from them.

e-mailed them 2 days later telling them I was cancelling my insurance because their cust service was crap, they responded immediately with my cover note attached.

They tell you to e-mail them, then they have a caveat on their site telling you that you must wait at least 2 days for an e-mail response!

theres no such thing as A2 according to research of others on the forum. You did a full license with a 2 year probation period to put it in way rather than a restriction. So you did your full license started from day 1 since you passed!

I'm betting that my insurers are now going to kick up a fuss because I have "lied" about having my licence for two years longer than I have.

Do I just send them a copy of my new photocard and don't mention it or should I explain why it's 2 years forward of the date I gave them?

When dealing with insurers, honesty is key.

Tell them. They may be fine, they may want to up premiums. Bottom line - do not let THEM cancel the policy. If it comes to that point, YOU cancel it and walk away. Otherwise you have to declare to other companies that you had a policy revoked.

FFS, just having read your post on the restriction lifting, I thought, hmm, that sounds exactly like the sort of fuckup the DVLA would make! Check my license and lo and behold, I passed my test November 2007, my A license is shown as starting from 15-11-09!

Fuckers, was months ago I got it updated as well so this is going to be a ballache!

tbh it seems to be something they do as standard. I knew this and sent them a letter telling them not to do this but they have done so anyway.

I think it might be quite likely that they won't put the original pass date on there.

Still, it's pretty rediculous that they do this. I'd prefer to have the original date on there with my restriction code still on.

The only reason I send the license off to get the restriction code taken off was because I got pulled by a couple of traffic police who didn't have a clue what it meant and kept my at the roadside for an hour while they worked out I did, actually, have a license to ride a full power bike after two years and the code had expired. Thought it would make my life easier not having it on there to confuse the poor policemen in future, but obviously not! Not sure how I'm going to explain how I've got 4 years no claims but have only held my license for 3!

Hoping I've still got my original test pass certificate, if so I'll take that in with my photocard license and ask them to correct it.

Don't worry about having to explain your no claims as it is very normal to have more years no claims than length of licence held. Bear in mind many people ride on a CBT and build up no claims before they have sat their test, myself included.

The only real issue I can think of is claiming you've had a licence for 4 years, crash, and then insurers try and say you lied to them and that you've only had your licence for two years.

Either that, or as I am anticipating, my insurers are going to accuse me of lying when I send them a copy of my photocard.

Moving the "From" date on the photocard is fixed DVLA policy, they don't even seem to understand the problem with it, and claim not to have heard about any insurers having difficulties either Exclamation

Roger, have you got a copy of the email you sent to them?

I might also send your email just re-worded. The more people who express concern, the more likely they are to do something about it.

Also... wtf do I do if I don't have my pass certificate? I had to send mine to the DVLA to get my license added as I had my car theory a few days after my bike test.

This is beyond a joke now, we need to get as many people as possible to contact the DVLA about this!

I write with reference to the "From" dates shown on photocard driving
licenses, and specifically motorcycle categories.

When a driver passes the (module 2) test on a "standard" / A2 class of
motorcycle, category A (as defined in 91/439/EEC) is added to section
9 of the driver's license, section 10 ("From") shows the date that the
test was passed and section 12 shows "=<25KW" to indicate that the
driver is still within the 2 year restricted period defined in
91/439/EEC.

At the next time that the license is surrendered (if more than 2 years
after the date of obtaining category A), the new copy is returned with
the "=<25KW" code removed from section 12 and the "From" date in
section 10 is set to the date 2 years after the test was passed (or to
the date when Accelerated Access was passed). The counterpart is also
updated to show that the driver previously held category "A2"
entitlement, which is incorrect as no such license category exists
(yet).

Leaving aside the issue of the counterpart, I understand that nothing
on the photocard is technically inaccurate when taken in the context
of the coding that the DVLA has chosen to use. However, is the DVLA
aware of the ongoing problems and cost that changing the "From" date
causes for motorcycle owners when obtaining insurance, and the strong
incentive that it provides for them to retain rather than surrender
photocards?

The majority of motorcycle insurers do not distinguish between "A
=<25KW" and "A" when quoting on and issuing insurance, and nor should
they since they are the same license category. They insist only that
the rider be licensed for the vehicle being ridden. Riders therefore
can and do and often must truthfully claim to have held category A
entitlement from their pass date, whether the category A was obtained
via a standard/A2 or large/DAS motorcycle. However, when insurers ask
to see evidence of license entitlement (at policy inception or
following a claim) they inevitably insist on using the "From" date
shown on the photocard as evidence of how long the rider has held
entitlement. By changing the "From" date when "upgrading" a category A
entitlement, the DVLA is essentially removing 2 years of license
entitlement from riders and increasing their insurance costs, a
nonsensical situation when upgrading the license category should, if
anything, reduce them.

What is worse is that this system punishes honesty. Informed riders
can and do delay obtaining an updated license as long as possible, or
simply indefinitely retain the photocard showing a "From" date of
their actual category A pass date, and present that when required by
insurers. I understand that this is illegal, but that does not prevent
it happening. Indeed, it is commonly suggested among UK motorcyclists
that riders would benefit from "losing" their photocards when
obtaining a newer copy, then "finding" them later when necessary.

Given that, will the DVLA reconsider the position on changing the
"From" date when removing the "=<25K" code from section 12? I note
that sections 9 and 12 taken together unambiguously define the exact
category of license held, and that changing the "From" date is an
arbitrary decision, entirely at the DVLA's discretion. Not changing
the "From" date would at a stroke both prevent many pointless and
burdensome insurance disputes, and remove the incentive for drivers to
illegally retain rather than to surrender their photocards.

This is a choice, not an absolute fact. Sections 9 and 12 taken
together unambiguously specify the exact entitlement. The "From" date
in section 10 is entirely within your remit.

You are able, but you choose not to. Why?

Specifically, why do you consider "A <= 25" to be a different
"category" to "A" for the purposes of listing "From"? It is not.
91/439/EEC makes no such distinction in the license "category".
Again, recording entitlement on the photocard is a decision taken by
the DVLA, it is not mandated by any Directive, Statute or Regulation
that I am aware of.

Do you at least acknowledge the awkward situation in which you are
placing drivers? I obtained an "A" category - exactly as defined by
91/439/EEC - on 30/03/2010. This date is currently shown on my
photocard. However, in future years, my "A" entitlement will be shown
as "from" 30/03/2012.

Are you aware of the financial impact of doing this with regard to insurance?

I should explain that the “standard A” test pass results in the
restriction code (less than 25 kilowatts power output) being placed
alongside category A on the licence, with the intention of showing the
driver’s limitation to that size motorcycle for two years. If a driver
chooses to exchange his licence after the two year period has elapsed,
he may do so, and the standard, restricted A category moves on to the
entitlement history section of the counterpart while the large
category A, denoting unrestricted motorcycles, takes its place on the
driving licence card. (We can confirm that it is “standard A” with the
restriction code which represents restricted motorcycles, and not “A2”
which, as you say, is not a current driving licence category.)

Large (unrestricted) category A entitlement will be shown on the
exchanged licence as starting two years from the test pass date. To
show it starting from the original test pass date would be an
inaccurate reflection of the driver’s entitlement during the two year
period.

We believe that the way motorcycle entitlement is shown on the licence
and counterpart best reflects the requirements of legislation. We have
not been made aware of any particular difficulties for insurance
companies in interpreting the information, but would be happy to
provide an explanation to your insurance company if you believe that
is warranted.
