I think he'll be fine as long as he can justify why he used his gun.
If it was locked in the cabinet (or secured as detailed in his licence) then he should be ok, if he had it stood behind the door or laid on the floor beside the bed due to the previous 4 break-ins, then he may have a problem as it becomes premeditated.
Depends if he shot them in the back or front too.... |

The men were on his property with the intention of doing wrong.
This is all the police need to look at and he should be released immediately.
They'll probably try to claim compensation from the cottage owners next. ____________________ Nobby the Bastard: How yo tell the difference between the actual japanese and her just screaming because she's had live fish stuck up her arse? Hang on, they do need to establish what happened. It's not like Midsomer Murders where the villains always say "You'll never prove it, Barnaby - oh all right, I did it, plus here's all the other loose ends that need tidying up for dramatic closure."
That said, he should be billing them for cleaning their blood off the carpet. ____________________ Biking is 1/20th as dangerous as horse riding.

I got up at 12:20am and took my shotgun from the cabinet and some cartridges. I was on my way to sit up for a troublesome fox that had been killing chickens / lambs. Upon descending the stairs I became aware of what appeared to be a number of criminals breaking in to my home. I shouted several warnings that I was armed yet the criminals ignored my warnings and proceeded to break in to my home. As they advanced en masse towards me I fired at them in self defence your Honour. |

Will only wash if he doesn't have a moderated rimfire or centrefire rifle with fox/vermin on his ticket.
As a farm hand, living on a farm, I'd imagine he has.

| Ben-B wrote: | Whilst I agree to the right to defend your property, I believe it needs to be done with the least amount of force necessary and appropriate.
For example, upon catching a burglar in your house, telling them to get out. Many of them probably would run if they got spotted.
Saying you're armed and will fire, then firing a warning shot (where practical) prior to actually shooting them.
But to spot them and shoot them straight away when there is no immediate and direct threat to you or your family is wrong.
It's the general rule of self defence, fight fire with fire... if someone punches you in the face and you grab a knife and stab them to death, that is disproportional. If someone pulls a knife on you and attempts to attack you, and you grab say a brick or something and smash them round the head killing them, that's a reasonable level of self defence.
It's an awkward and tough debate though, who decides what is a certain level of threat and an equally reasonable level of self defence or defence of ones property? |
Using the minimum level force necessary is something that should apply to the police who are trained in force levels and such officially (the quality of the training doesn't matter here). Normal citizens, or off duty police, should be able to use the maximum force they feel is necessary to eliminate the threat, but no more than that. You should never, ever, have to take it easy on a burglar by gambling with your safety by exposing yourself to greater danger. If you choose to do so, you are free to do so, it your's and your family's lives, but don't force such a requirement upon others lives and their family's lives, as it is reprehensible. The burglars have the right to not break-in in the first place, but they do so knowing they could kill/injure you, especially as you and your family are quite vulnerable when asleep, and are more than happy to take such a gamble with your life.

Interesting point... shotgun licences are only permitted to have birdshot, which isn't for hunting foxes. That generally requires buckshot, or a rifle, both are firearms licence items! |

Not 100% accurate, slugs and tri-ball certainly are FAC items, but buckshot is not.
The letter of the law regarding shotgun ammunition (which can legally be possessed without a license)
| Quote: | (4)This section applies to any ammunition for a firearm, except the following articles, namely:—
(a)cartridges containing five or more shot, none of which exceeds ·36 inch in diameter;
(b)ammunition for an air gun, air rifle or air pistol; and
(c)blank cartridges not more than one inch in diameter measured immediately in front of the rim or cannelure of the base of the cartridge." |
For instance take 00 buckshot which is a nominal .32 diameter and has 7-9 shot per shell would be legal on the basis that there is more than five shot and each piece is less than the legal maximum. Certainly No4. buck would be legal, and quite adequate for fuck-a-man-up purposes, each ball being just under 1/4 inch.
Of course buckshot is relatively rare/expensive in UK gunshops. Nothing to stop you buying one of these and melting down cheapo birdshot though, you never know when a naughty deer might come rampaging through the farmyard in the dead of night! |

Bullshit. If someone breaks into my house in the dead of the night, I'm not going to stand there, watch him, make him aware of my presence and see if he comes at me with a weapon or not before calculating my reaction. He has broken the law and violated my rights to not be a victim of crime, so all bets are off. That bastard is going down and staying down. I'm very fortunate that no matter what route I take down stairs, there's plenty of large solid objects that will at the very least immobilise a person, if not permanently disable them, and I certainly wont be afraid to use them regardless of whether he is armed or not.
The guy who shot the burglar is a hero. In my opinion they lost any rights to a legal defence the second they were in a place they legally should not be. ____________________ 1977 Honda CG125

This is 100% correct.
I've actually got a few boxes of 'big stuff' and have shot plenty of foxes with No. 1 shot. ____________________ Triumph Daytona 675 track bike + girlfriend's Honda Hornet 600
