IMO he should (should the burglars be convicted as such) be let off scot free.

Done a service to the community and the wider human race in general. They might think again next time.

I think he'll be fine as long as he can justify why he used his gun.

If it was locked in the cabinet (or secured as detailed in his licence) then he should be ok, if he had it stood behind the door or laid on the floor beside the bed due to the previous 4 break-ins, then he may have a problem as it becomes premeditated.

Depends if he shot them in the back or front too.... Thumbs Up

Government and police don't seem to interested in the victims of crime. Anyone would think they were more interested in taking guns from civilians than from criminals.

The men were on his property with the intention of doing wrong.

This is all the police need to look at and he should be released immediately.

They'll probably try to claim compensation from the cottage owners next.

Hang on, they do need to establish what happened. It's not like Midsomer Murders where the villains always say "You'll never prove it, Barnaby - oh all right, I did it, plus here's all the other loose ends that need tidying up for dramatic closure."

That said, he should be billing them for cleaning their blood off the carpet.

I got up at 12:20am and took my shotgun from the cabinet and some cartridges. I was on my way to sit up for a troublesome fox that had been killing chickens / lambs. Upon descending the stairs I became aware of what appeared to be a number of criminals breaking in to my home. I shouted several warnings that I was armed yet the criminals ignored my warnings and proceeded to break in to my home. As they advanced en masse towards me I fired at them in self defence your Honour. Wink

If the police changed shotgun licences to include buckshot and slugs, and not just birdshot, the NHS could have been saved a few quid here by getting the job done right first time.

Let him go and give me an OBE, IMO if they are on his property and shouldn't be I'd give em both barrels. As and aside 4 blokes to rob a house sounds like overkill, it could have been something much worse.

If there is someone in my house at night at they shouldn't be I would hit them with something very heavy until they stop moving. Reasonable force goes out the fucking window when my families safety comes into it.

Actually, this is a perennial question on shooting forums.

You can only defend yourself with what you have 'to hand' - if the gun is locked away, then thats not to hand. If its beside the bed etc, then it should have been locked up.

They don't have to believe it, they just have to prefer it to the alternative, which is convicting him for protecting himself.

Outside of the usual Crouch End chatterati, I doubt there are many decent people who would condemn him.

The prosecution needs to prove beyond reasonable doubt.

If there is reasonable doubt, that SHOULD theoretically demand a not guilty verdict from a jury.

When there is multiple people breaking into your house late at night, do you want to make the assumption that they are only burglars? They could be just burglars, or they could be rapists, torturers, murderers etc etc. Do you want to risk your wife/kids/dogs safety on the premise that they are "just burglars"?

Funnily enough in most US law, you as a shooter will be busted for firing a "warning shot" or "shot him in the leg". So their reasoning goes use of a firearm is lethal force. To justify using lethal force you need to be in fear of your life. If you genuinely fear for your life you shoot for center of mass, not in the air or try to line up a silly leg shot.

If you choose to do so, you are free to do so, it your's and your family's lives, but don't force such a requirement upon others lives and their family's lives, as it is reprehensible. The burglars have the right to not break-in in the first place, but they do so knowing they could kill/injure you, especially as you and your family are quite vulnerable when asleep, and are more than happy to take such a gamble with your life.

Interesting point... shotgun licences are only permitted to have birdshot, which isn't for hunting foxes. That generally requires buckshot, or a rifle, both are firearms licence items!

Not 100% accurate, slugs and tri-ball certainly are FAC items, but buckshot is not.

Bullshit. If someone breaks into my house in the dead of the night, I'm not going to stand there, watch him, make him aware of my presence and see if he comes at me with a weapon or not before calculating my reaction. He has broken the law and violated my rights to not be a victim of crime, so all bets are off. That bastard is going down and staying down. I'm very fortunate that no matter what route I take down stairs, there's plenty of large solid objects that will at the very least immobilise a person, if not permanently disable them, and I certainly wont be afraid to use them regardless of whether he is armed or not.

The guy who shot the burglar is a hero. In my opinion they lost any rights to a legal defence the second they were in a place they legally should not be.

This is 100% correct.

I've actually got a few boxes of 'big stuff' and have shot plenty of foxes with No. 1 shot.
