Don't know. As you have an illegal exhaust I'm not sure where you would stand. Personally I'd ignore it.

Surely if you're a courier you really ought to fix the issue? Would it not be better to pay a mechanic to fix it with a credit card, and then courier to earn money to pay the credit card?

You're being completely reasonable, the police won't care or do anything.

I would imagine the police wouldn't even come out, because if the situation is exactly how you have explained, you're not doing anything bad or within hours that would usually be frowned upon. Sounds like you just have mardy neighbours. They need to get out more.

You are free to work on your bike whenever you wish.

I believe you can make a specific amount of noise between certain hours of the day. 7am and 11pm by the looks of it, so working between 8am and 6pm is reasonable.

I got a complaint about my bike, go fuck basically. Close your windows or stop every chav with a 4 inch exhaust on his car or buzzy can on his ped. Then I'll consider shutting up.

Even if they complain to council...

Quote:
Under Section 80 of the Environmental Protection Act 1990 (EPA), they must take "all reasonable steps" to investigate your complaint. They may write to the person causing the nuisance saying that a complaint has been made, asking them to take any steps that may be necessary to reduce noise. If they believe a statutory nuisance is occurring or likely to occur or recur they must take action. A statutory nuisance is defined in the EPA as - "noise emitted from premises so as to be prejudicial to health or a nuisance".

Noise from a motorcycle with a road legal exhaust, yeah... next to no chance.

They would have loved the GSXR Rolling Eyes

Do nothing. They are the twats unless you are also out at night. Only problem is if you wind the village idiot up he might do something to the bike at night.

My bike is in my garden whan i work on it but that is right next to the neighbours windows. I tend to finish up working at 7pm. If i need to do anything after that involves starting the bike i will wheel it out into the street. Saying that i do have good neighbours bar one who i will gladly put one on his chin if he ever said anything about noise as his dog is louder than my bike and barks almost all day at its own shadow.

The 'situation' is summed up here https://www.environmental-protection.org.uk/noise/environmental-noise/noise-pollution/#wa469

It's a bit vague but this is the relevant bit...

Noise nuisance

Quote:
A nuisance is often difficult to establish but, generally speaking, if something is unreasonable to the average person, a court might decide it is a statutory nuisance. Noise nuisance is covered by Part III of the Environmental Protection Act 1990 (EPA). This law empowers local authorities to deal with noise from fixed premises (including land) if they consider that the noise amounts to a statutory nuisance. Proceedings may be taken against noise from factories, shops, pubs, dwellings and stationary vehicles.

Keep a diary, details of the times they've spoken to you about it and what you offered to do and how you modified your working time to suit the suggestions.

If plod do turn up (unlikely) show them the diary. Ask them to speak to the individuals who are complaining and offer to sit down with them and sort it out.

Noisy neighbours are only offered mediation when it's available - sad thing is, if the 'problem' has a numberplate, there's the good ol' section 59 to whip it away from you.

As always EVIDENCE is king.

Not with noise it isn't, neither is being reasonable.

My mum runs a community centre that she lets out for functions, nothing late night, always shuts down by midnight and the music was always kept down to a level where it was barely audible from the street. Well some tosser four streets away complained to the council about the noise and got some of his neighbours to sign a petition. Mum had the noise levels professionally checked from one street away and is was no more than the road traffic noise.

It made no difference to the council, the simple fact that someone had complained about something he couldn't even hear was enough for a noise abatement order (or whatever they call it) to be slapped on the centre. Cost a bloody fortune installing soundproofing and a sound system that cuts out if someone opens a door or window!

/\ This, if you were working on the bike outside of these times then the council could possibly get involved. I don't think the Police would bother to be honest.
Sounds like you are being reasonable by trying to compromise on the time of day you're working on the bike, sounds like your neighbours are just being unfair. In which case I'd continue as before, 11-12 in the morning can't be a problem as most people are at work anyway & not running the bike past 5-6 in the evening is also being bloody considerate.

You could pre-empt the situation by giving the local council a call, explain the situation and see where you stand (or email them so you have a record of their response). I'm pretty sure they won't take any action given the time of day you're working on the bike. Where I used to live the family next door were a fecking noisy bunch, lots of parties and noise well past 2 in the morning and it took literally months for any action from the council. We & the other neighbours had to go through 'mediation' which said family never bothered showing up for, even then the council were reluctant to do anything.

Out of interest do you rent the property/shared ownership? If so they might take the complaint up with the landlord/housing association. If this is the case contact them and see where you stand.

Sounds like you've been reasonable and they have not so see where you stand and f*ck 'em.

Do you have a lawn? If so beg / steal / borrow an old petrol lawn mower. The time I borrowed one from my uncle for a couple of weeks was amusing when a pissy pants neighbour complained at the 'noise' leaving my bike with standard can on outside the garage running for at most 60 seconds while I locked the garage door and put my lid on.

Whats winding me up, is the fact that i've lost over a days work time due to being considerate. When i've had acess to an industrial unit it's not been uncommon for me to start at 2/3ish and work right through till 6-7ish the next day!

That and the fact that i spent two days last week having drills stuck in the wall at around 8-8.30 in the morning waking me up.

And then the fellah two doors up threatening to kick my head in because i've ruined his weekend with "THAT FUCKING BIKE" who's been lighting realy stinky bonfires, burning plastic and shit scince...well as long as i've lived here, so 23 years? Keeping in mind he'll light up around 4-5ish, regardless of my washing being on the line.

S59 is my big worry tbh...have ordered E-mark tag for can just in case.

Certainly sounds like they're unreasonable bastids then, Check where you stand to see what action (if any) could be taken against you......I think it's unlikely though.

On a different note I played the drums many years ago, I was in a band and having pro tuition at the time so I needed to practice (a lot). Neighbours either side were fine with my playing. Like you I would try and do it middle of the day/early evening, guy who lived at the back kicked off hurling a load of abuse over the fence....Not sure how long he'd be stood there shouting, I couldn't hear a thing and only stopped for a smoke. Laughing I spoke to the council about it and they said as long as it wasn't for more than an hour a day at a "reasonable time of day" it was OK.

The thing with your situation is that it's virtually a temporary thing, bike is running sweet = no more noise.........Why are people so bloody awkward. Rolling Eyes

With respect, you're wrong here. OP is worried about Police coming over and potentially wagging a finger. If he can prove what he's done, they'll take a much different approach.

Councils, on the other hand are open to abuse.

The police won't give a toss, noise complaints are a local council issue.

Vehicle noise will give police a raging stiff one knowing it may be a non legal exhaust system, although..having one fitted to a bike off the road is not an offence Wink

My point precisely, otherwise the police would just camp outside Kwik-Fit!

My other point is that should the neighbours decide to get arsey with the council don't be surprised if they get their own way.

Um... what?

You had an opportunity to sort that one out there and then. You can't reason with mentals.

All that said, if you need a reliable bike for work then sell the bloody shed and get one that works.

Your being too polite tell them to do one and get a job, just crack on and fix it and don't let them stress you out.

When I need to do work on my bike I just grab the tank bag with tools and head down to the local supermarket at night (Tesco's).

Great lighting on the car park at night, hardly anyone on there at all so it won't affect anyone as well as peace and quiet.

What kind of work are you doing? Adjusting your mirrors? This weekend I'll be replacing C+S and there's no way I could/would do that in a car park...
Unless it was like ten feet from my house I suppose...

I wouldn't worry, particularly if you're only making noise during normal working house.

If there were builders doing an extension on the house opposite they'd be making a racket all day long, people might be annoyed but wouldn't really have grounds to complain about that if it was at "reasonable" times of the day.

I'd feel the same with your situation. You've offered to come to an arrangement to resolve it to your neighbours satisfaction, they've failed to cooperate with that offer so not your problem in my view
