What I hoped to be a nice little ride ended up leaving me with two bent wheels and brown pants.

I have a couple more pics of it, sort of showing how big it is, although I plan to go back tomorrow morning to get some more, including as a mate suggested, a nice wide angle to show where it is.

I've checked Essex County Council's website and its been reported apparently, on the 21st, But was followed up on the 28th by "No further action" which seems mad considering the size of it, that hasn't formed in a couple of days.

I'm hoping to claim for both wheels due to the below (this is the rear, front is very similar)

Both tyres have lost air, Have yet to check them for defects. Is there any chance of the forks bending from this kind of impact?

Basically want advise if anybody else has claimed (Successfully or not (if not, why?)) and if there is anything I've missed?

Just need to find out where to report it to the council now.

PS: I wasn't going fast, Roughly 40/50mph (NSL road), its on a slight left hand corner and there was a car oncoming, had no chance to see it.

TLDR - Hit pot hole, Advice for claiming?

Make sure you go back and measure the depth. A picture with your tape in it would also be useful for evidence I'd say.

Get a pic with a ruler measuring the depth, this ( I doubt) may have been why there was no further action because of the lack of depth but this seems deep enough!

It is very handy that it has been reported before, more for you to stand on.

Thanks for the links, I'd persue it myself, and JM, Kinda helpful, Will check it out.

I think I'll call the council tomorrow (if the're open), I know it would be better to have a paper email trail, but I want it sorted ASAP (if possible!)

Already planning to go back and get decent depth pictures.

Clutchy, I'm amazed I stayed on.

Will pictures of the bent wheels be enough for the council? I'd like to bash them straight'er so I can at least use the bike around town

Tbh, would also be worth calling the Police about that, telling them it's a danger to any cyclist/motorcyclist. Bike cops will put pressure on the the relevant party to get it repaired, and will stand guard to make sure nobody gets hurt. As that costs the council, etc, money, it's in their interest to repair it. I have had cause to do this once, and it took the City's finest 15min to attend and close the lane. Two hours later, the pothole was being filled by some contractors.

Also, it may not be the council's responsibility, which kind of makes sense if they say 'no further action', as it may be the county council or Highways Agency or, in London, TFL's responsibility. Sadly, it's up to you to find out whom to contact...

Absolutely no way to find anybody at a council tomorrow, so call them on Wednesday, get their name, check they look after the road and get them to explain the 'no further action' status. But before that, report it to the Police to make sure somebody else doesn't get caught out.

Years ago l hit a pot hole which caused me to crash, both myself and the bike were damaged. I contacted my insurance company as l was fully comp to claim on the bike as it was a right off, l expected at the time to take it as a fault claim on my insurance but they manged to get there solicitors to take TFL to court over the pot hole as it was from memory over 6 inches deep and around 12 inches wide and had been reported a number of times by other motorists. In the end after around a year TFL settled out of court and l was paid out for the bike plus injury's.

I checked on the council website, It says its a road that is the councils responibility (only Major A-roads and motorways are highways in this area it seems).

I'm not fully comp so no point in notifying insurance company IMO.

I hope its a good claim too, Deffo needs a new front tyre (only replaced 2k ago too) although the rear looks Okay, I'd like to replace it for piece of mind, plus its nearing the end of its life. Wheels, Used ones are about £100 a peice so soon adds up.

Luckily its plently far from you, Its just outside Great Dunmow heading towards Bran end etc.

Stick a claim in. If they've assessed it and it's got worse since then, you have a very valid claim. Every vehicle that goes over it will cause it to crumble some more, so a pothole can quite quickly deteriorate.

As others have said, measure the depth and photograph that too. Councils have certain tolerance levels and if it's over a certain depth then they will urgently repair it. If they have to take action to repair it, that also adds weight to your case.

I came across a nasty pothole earlier this year, with two stranded cars with blowouts in close proximity. It was quite clear it was down to the pothole, so I made sure the drivers both had a police incident number and called the council out to fix it. Within half an hour the council highways team were out filling it in. On an arterial road it was an urgent case. It is always worth reporting potholes, because they can get much worse very quickly.

A conversation with your council's highways department will give you the right way to make a claim. If not, a letter fired to their legal services department with all your evidence attached should do the job.

Over here in Northern Ireland IF the pothole has the spray can ring around it YOU cannot claim,As the council or roads agency has Marked the pothole so the onus is on the road user to avoid the pothole as its Marked.I made a claim for wheel bearings for a vw sorricco after hitting a huge pothole on the blind side of a brow of a hill about ten years ago and got a cheque to cover the bearings which i replaced myself.Be sure to take a tape measure to indicate how deep and wide the pothole is ,If there are Road signs or lamp posts nearby there should be a number on them somewhere and measure the distance along with road name or number.The more information you give them ,The easier it is to find the pothole is it near a shop/garage/pub/Set of traffic lights/Zebra crossing.Make sure to get your pictures as soon as possible take a newspaper with the headline clear as that can prove the date you are claiming the damage happened.Good luck and let us know how you get on.Francis
