OK a 50cc under new laws can't exceed 28 MPH My question is will this apply to a 50c geared motocross bike made before the law ? it hits about 60 MPH i am also 21 if that helps.

It hits 50mph max and its illegal if you haven't declared it.

Why not get a 125 2 stroke?

It depends on what definition you're using.

The new AM license lets you ride a machine up to 45kph =~ 28mph. But AFAIK we haven't amended the C&U or MOT regs, so they'll use different top speeds as limiting definitions for a "moped".

And that's 'design' speed anyway. WTF does that even mean, and how can it be applied to a vehicle in the real world?

I know some Plod love to do Operation Pedboi sweeps, tug 16 year olds, put their 'peds' on rolling roads and offer them cautions for Otherwise Than In Accordance. But you'd have to be a prize chump to fess up to that rather than telling them that you'll see them in court, sometime after Australia freezes over.

That's a motorcycle by any definition. You need at least an A1 or a provisional A license to ride it. If you have a current CBT, you're fine.

That's for licensing, mind. Whether the vehicle is mis-registered and being MOT'd and insured as a moped are different issues, which you'd have to take up with the DLVA, VOSA, your insurer and Plod.
