Hi

I have a bike where my insurance expired, and the tax was still running.

The DVLA sent me a nasty letter saying your bike is not sorned, please sorn it else we will fine you £100.

I sorned it there and then, sent off the tax disc to get a refund. Haven't cashed the cheque yet though.

They've now sent me a nasty letter saying I have to pay them £100 as it wasn't sorned early enough.

Do I? Will they take me to court?

I know it's been covered time and time again, I just don't want to get into any trouble. I can scan the letter up here tonight if it helps.

Then you're guilty of a criminal offence. Are you sure you're recollecting correctly?

I got those for different bikes, reminder, £50 bribe, £100 bribe, SORNed months later, ignored them all and nothing came of it.

But that was in 2011, they may have decided to pursue these now. If they do, you're on a sticky wicket because even if you do, uh, remember sending off the SORN in plenty of time, the legislation attempts to put the burden of proof on you to supply "evidence" of it.

They did this to me.

Best bit was, I'd sorned the bike and cashed the cheque, then they tried to tell me I hadn't done either.

I did it online and found the letter I filled in in my downloads on the PC so sent that and they left me alone.

Maybe look for the same thing?

I can go one better, I still have the cheque. I'll have to study the letter a bit more to try and figure out what they're trying to bribe me for first.

They look like the same letter to me?

So, hang on, the top of the letter says your SORN started in Dec 2012 and the offence is dated as being in Jan 2013?

So, basically they're saying that you've not insured it while the bike was on SORN (evidence on the same letter they've sent) so the letter actually clears you of the same offence it accuses you of?

or have I missed something?

That's how I read it as well. Confused

The vehicle was not insured on 17/1/13 but as it was already off the road then it didn't need to be!

Sorry - Might not be clear. When the bottom letter was sent, the bike wasn't sorned.

I immediately sorned, they sent me the confirmation slip.

They then sent me the second letter (top) which I scanned in with the confirmation of SORN on top for all you to see on here.

Edit, they are the same letter, my error.

1st letter dated 17/01 as above

SORN declared straight away

SORN confirmation recieved 22/01

Second letter (identical, except 'FINAL NOTICE') recieved 04/03

But they have backdated your SORN, so according to their own letter your vehicle was legal on the date that they state.

They can't have it both ways, if your SORN hadn't started til AFTER the alleged date they could fine you. It didn't, so I don't think they can.

I would send them a polite letter telling asking them to check their records as the vehicle was SORN'd at the time of the alleged offence and that you have letters from them proving this.
This seems to be an own goal on their behalf.

What a bunch of muppets heh.

My bike will be on the road at the end of this month, when the insurance is sorted.

This is what DVLA site said when I tried to declare SORN.
DVLA wrote:

Declare SORN (Taking your vehicle off the road)
Tax Disc Refund
A SORN declaration is not due for this vehicle until: 01 01 2014
As you are declaring SORN before this date you may be entitled to a refund on the balance of the tax disc value.
This refund can be claimed by completing a Refund Application form (V14) and returning the tax disc with the form.


Should I still declare it as SORN? It'll only be off the road for another two weeks... Thinking

EDIT: Went ahead and SORN'd it. Better safe than sorry. Forget paying £100 Shocked

The letter came seperate to the SORN confirmation, it's just scanned on top of the letter as I stapled it to it.

So, to clarify, the SORN certificate states it was SORNED when the alleged offence took place?

The DVLA's own paperwork puts you firmly in the clear?

Might as well write them a letter, but I'd get some popcorn ready for the impending court failure (on the DVLA's side) on the way home unless someone manages to see the fact that they're not going to win this one.
