PostPosted: 21:53 - 27 Mar 2013    Post subject: Lying BMW driving scumbag. UPDATE No'3 On Page 7 29/4/13 Reply with quote

Late last year I was sat at traffic lights in my worthless Fiat Punto when I Was hit from behind by an older gentleman in a few weeks old top of the range BMW.
The damage to my car was minimal, a cracked bumper and numberplate.
His BMW faired less well, headlight, bumper, grille, bonnet and the airbags went off.
We exchanged details, but decided not to go through insurance as he wanted to protect his no claims and my car is worth less than jivebunny's life. £50 was given to me to sort a used bumper and a new plate, happy days.

I had forgotten about the incident until yesterday when I had a call from my insurers..... (you can see where this is going).........

HE HAS CLAIMED I REVERSED INTO HIM!!!!!!

Claiming for £4500 damages to the car and £9k personal injuries!!!

What an absolute bellend. If IF he ends up winning this, I am going to cause £4.5k of damage to his car and £9k of damage to him.
I really wish I had got him to sign something to say he was at fault now!

Could the length of time he has allowed to lapse be in your favour?

I hope this works out for you.

- Hang on, how hard would you have to be reversing into him for the airbags to go off?!?

Loss adjusted Thumbs Up

It'll be rather difficult for him to prove that. Don't worry, just repeat the truth to them and he'll have to prove otherwise...

What reason would you have to reverse from a red light?

This won't go in his favour.

He has zero chance of winning if you stick to your guns, the only way for you to cause that damage is if you were reversing at high speed Laughing

Just for future reference if anyone has something similar happen, write out a document and copy it. both you and them sign them.
make sure it says full and final settlement for the incident that happened date/time/location between you and them

considerig the damage to his car he would of had to go through insurance, especially with airbags goig off. lesson learned, though he can also just get someone to say they witnessed it and boom its your fault.

Did you report it to your insurance company? If you did an incident report at the time, it will carry a lot of weight legally. It's called a concurrent record.

Can you prove he gave you the money? Please say he was stupid enough to give you a cheque? Tantamount to admitting liability.

Some shyster claims lawyer has found out about his bump and has persuaded him he'll get a load of cash out of it is what's happened.

EDIT:
Will an airbag even deploy in a stationary vehicle?

Also forgot to add, my insurers now say I have an unresolved claim and have upped my premium by £80 a month.

No he paid in cash, but withdrew it from a cashpoint 50 meteres from the scene.

I would contact BMW to find out what would cause the airbags to go off.

i.e. over 15mph moving forwards and in excess of 2g deceleration.

This simple information could put an immediate end to his bullshit if he says he was stationary in his statement.

That's the problem with paying monthly for your insurance. You'll be able to claim it back once he realises that his claim is fraudulent and holds no merit and is convinced to rethink his claim

This is the problem with trying to do ANYONE a favour when they have caused an accident. They turn in to cunts and try to fuck you in the ass.

Don't bother, it's really not worth it. If you are not liable, stitch them up before they do the same to you!

Imagine if we came across an alien species on a nearby planet who we somehow managed to observe without intruding on them at all. Now imagine if this species were not communal, didn't think about the greater good of their society, and generally were out to stab each other in the back and did silly useless petty things serving no purpose to the greater good of life. I mean imagine if even a small minority of the aliens were like this. You'd find it a bit ridiculous and hilarious in equal measure.

Sometimes I hate humans. Hah.

What a massive cock. A sort of similar thing happened to me, but I actually was to blame for the incident so I just took it. He really pushed for everything though - him and his wife.

Unfortunately the moral of the story is to trust no-one.

I'd have been inclined to have raped the Beemer driving for personal injury in the first place.

Were there any CCTV cameras in the vicinity? Although a bit late now.

It's going to be his word against yours so he won't get anywhere anyway.

Don't suppose you took his home address btw, just so, y'know Wink

Deny any knowledge of said incident as there is no damage to your car.

Did you post about it at the time on any forums?

This could help backup your story but also cause your insurance company to see some of the other shit you've been up to.

That raises another point actually. If you settled up at the scene what details did you exchange? Did he take yours for the purpose of claiming on his own fully comp? If not he must of taken your plate discretely for the sole reason of doing this, snide cunt.

I really cannot understand that mindset, "hmm, I remember that guy who's day I spoiled a few months ago, he was perfectly amicable with not getting insurance involved, well I'll see if I can't get a few grand out of him"

I would definitely speak to the police ASAP, with something like this I wouldn't trust the insurance companies to sort it out in a just and timely manner.

Where the chuff does your insurer get the idea that they can retroactively put your risk through the roof and unilaterally increase your premium mid way through a policy that was (almost certainly) paid up front with a loan from the broker?

Dream on that you'll be claiming that money back from anyone.

Read your contract, get a complaint in right away.

Get yourself a witness, pronto.

Tell them what to say. (I.e what happened, say they were walking past and only approached you later or something, someone you can trust to go to court if needs be who won't buckle under pressure giving the game away.)

Unlikely for this to be needed. As said it's usually the fault of the person behind. Given the other aspects of the story (amount of time, traffic lights, etc) OP should be fine to prove his case without lying, or making things up.

That should be the proof you need as how would a complete stranger know what he withdrew from a cashpoint machine.

Report him as said.

Do this. Don't enter into any kind of frazzlement trying to outwit either insurers, it's plainly fraud.
