I believe so yes, based on this point:

The chain/belt must not have excessive slack and be in good condition, the guard must be secure and not fouling

However, you could read it as no guard = no problem.

My fazer passed last week and it had a missing bolt on the chain guard and they didn't say anything..

why the fuck would you not have a chainguard anyway? :/ I beleive a lot places will fail for it for the above but some may interpret as no guard, no problem

Irrelevant as far as I'm aware?

Personally seems a bit daft not having one, as it could potential save your leg from a flailing chain if it fails.

I've not had a chain guard/hugger installed on the ZX9 since my blow out which destroyed the hugger two years ago.

No advisory on either MOT from both a Honda main stealer nor a local bike garage.

Rule of thumb of an MOT is, if its there it needs to be secure. If it's not it doesn't count Thumbs Up

Advisory; but is a legal requirement I believe.
The cop who was having a go at me for riding in shorts and a t-shirt explained this (I did know, but pleaded ignorance as "it just passed an MOT").
I think he was annoyed that he couldn't get me for no tax, as it was no doubt showing as untaxed and I didn't have one on the bike - but had a fresh one in my pocket from the previous day.
