Hey, first post, whats up guys, I'm Tom nice to meet you.
Anyway right to the point, I purchased a Tmec Enduro 125 from some lad, works well rode it a fair bit and love it, but I forgot to ask for the papers since it was my first bike and I was anxious to get it home in the van, and I'm only young, 17.
I emailed him and asked for them and he said he is waiting for them to be posted and he will send them right to me, seems a bit suspicious if you ask me.
Lets say I have been sold a stolen bike, it's not my fault I didn't know but I know I should of asked and if he said he did not have them I would not of took the bike.. yadda yadda to the point, is there ANYWAY at all, I can possibly do something to gain them papers in my possession, say, new papers for the same bike?

It's the Chinese ver. of my bike You can apply for the v5c if you don't get it from the previous owner. Did you do a text check thingy on the bike? Not having the papers doesn't mean it's stolen, it does require an explanation tho, did he recently buy it & is selling it on quick (& why?) or is he selling it for someone else etc. ____________________ Yamaha MT-03 '08 (crashed)

Filling in and sending off the change of ownership papers is the sellers responsability, then only time you should be handling the registration document is when you sign it on purchasing the vehicle. The seller is supposed to give you a little green slip that was attached to it.
If you land up applying for a V5 in the way described by instigator, there is a good chance the DVLA will start chasing your mate for a penalty charge for failing to notify them of a change of ownership. They DO take people to court for it. The fine can be up to £2,000.
Might be worth letting him know that.
If he's lost the V5, it'll cost him £16 to get the DVLA to send out a replacement set of papers in his name. ____________________ “Rule one: Always stick around for one more drink. That's when things happen. That's when you find out everything you want to know.”

That's a strange chinky bike that, why a twin pot calliper on the back?
Hopefully the bike is legit, but of course I'm sure you've learnt in the future money and v5's should be exchanged when you make the deal. I think you should do a check on the reg to make sure it's not reported stolen, then give it 2 weeks maybe for any docs to show up then if nothing does you can just apply for a new logbook. ____________________ KTM 990 SMT & Suzuki DR-Z 400 SM |

There's no immediate panic. The V5C is a liability, not an asset. Until the seller notifies the DVLA of the change of keeper, he's responsible for the bike.
More fool him if he doesn't tell them, and it's entirely his responsibility to do so. He does not need the V5C to do that, and he should not wait.
If he doesn't know this, that's his problem, not yours. Send off the V62 whenever you feel like it, don't wait for him to sort it out. If he gets raped by the DVLA, it's his own fault for dithering. ____________________ Biking is 1/20th as dangerous as horse riding.

Oops, I was going to say that there's no charge for requesting a change of keeper to yourself (Capita Group Plc DVLA want to know who to pursue for their money), but...

Well, that's a bag of dicks. You can't tax it, and you'll have to pay to get a V5C in order to do so. In fact, you can't even SORN it without a V5C reference number! It might be worth writing to the DVLA to point this out, just for the lulz.
Not a mistake you'll be making again, I suspect. You'll definitely want to chase up the seller and tell him that it's in his best interests to write to the DVLA asap, and never mind waiting for the V5C to turn up.
Note that all you really "need" is his signature on a letter. If the DVLA actually checks them, that is. ____________________ Biking is 1/20th as dangerous as horse riding.
