A freelance IT worker reportedly faces court costs of £1,835 after failing to convince a judge that his conviction and sentence should be overturned because the law does not apply to him.
Timothy Ollerenshaw, 53, was told by the judge that he had only presented “legal nonsense” in his bid to quash a conviction for refusing to identify a person caught speeding in his car.
His claim of immunity was put to the magistrates’ court that convicted him in July, and subsequent papers sent by clerks came back bearing his claim to have “no contract” with them.
It seems to stem from his membership of Freemen of the Land, a group which says that all statute law is contractual and is only applicable if a person consents to it, KentOnline reports.
The newspaper added that, in court, he didn’t put forward a defence when invited to but argued: “The burden of proof is on the prosecution,” to which the judge replied: “I am perfectly aware of that.”
Presiding at Canterbury Crown Court, Judge James O’Mahony continued: “I rule that the Road Traffic Act is applicable to you, the same as it is to anyone else.
“There is a duty to provide that information and it is an offence to fail to do so. A document was submitted at the start of the proceedings which was legal nonsense.”
The judge threw out the appeal from the self-employed techie, who was told to pay £450 in costs, on top of a £750 fine and £635 in fees from the magistrates’ court, plus six penalty points on his driving licence.
Perhaps they should lose an e and try a different tact? |

Much like the same way a solicitor works - when these yuppies who believe in it end up in court, they go to someone 'knowledgeable' on the subject, and pay them money to try and get them out of the sticky spot. Hezter, it is nonsense, the legal system in place now has been for how long? Freemen of the land, in its current state, is very recent. Why are people so accepting of this 'frame of mind', yet will blow their stack at the thought of Sharia law, another 'frame of mind' becoming legitimate? |
