Well i payed for these fair and square and they never arrived, the seller has not been on msn sinse the sale but has been online the forums and claimed to have posted them. Mods wont do anything so what do you suggest.... ____________________ Derbi supermoto with cr500 engine, niceee |

www.derbi-club.com forums and i sorted out with him on there contacted him over msn to sort out price / payment, i payed him and then he said he would post them first class.
No goods have come and he has only been on the forum twice, and never on msn, no replies to PM's or E-mails, mods ignore the fact theres a theiving bugga on the forums,
I have no need for the clocks, i mean what do you expect me to wait a month? nope i bought something elsewhere (understandable rite??) so just want a simple refund thats all
for all i know the clocks are in the post and are just lost, but he claims he has posted them ages ago, i dont understand where i stand in terms of using the law against him, who cares if its £15 its the principle and the fact he shouldnt be able to get away with it...

You can file a buyer claim on Paypal and you'll then if it goes through get your £15 refunded.
I'd also post up something on the forum saying exactly what has happened so that other people don't get conned by him.
In regards to the law I'd suggest having read of the Trading Standards website and possibly calling them, depends on what was said in the posts about it and still going to be a shit load of hassle so unless you've got lots of spare time it'd be easier just to forget it. |

Your contract is with the seller and not with eBay, it is no more eBays fault if you get scammed on eBay than it is a free ads papers fault if you get scammed from someone in their paper.
You can take it up with the Trading Standards people |

If you payed by credit card refer it to them. They have to deal with fraud on your behalf and refund you.  |

Trading Standards will advise you on your rights but won't take out any action in civil cases such as these.
If you have his address the best option would be to write a letter to him via registered post (to ensure its' delivery) giving him a specific time limit (7 days for example) to either send the goods to you or alternatively your money back. Should no response be forthcoming then your next course of action is a claim via the small claims court - no solicitor is required so you avoid any hefty legal costs although a small amount is payable to the court prior to your claim (this can be reclaimed should you win your case).
Personally I would go along the lines of...
Further to the non delivery of goods that were paid for on (date) via paypal (reference #).
I am now making time the essence of my claim and would be grateful for a response within 7 days from the date of this letter. If no reply is forthcoming then I will have no option but to make a claim via the Small Claims section of my local County Court.
As you probably realise the evidence is pretty damning with regard to my right to a refund or the supply of the goods in question so I would expect a response from you shortly.
In my experience nine times out of ten a letter along these lines threatening some form of legal action does the trick.
