PostPosted: 21:10 - 19 Nov 2013    Post subject: New biker! First collision today - advice? Reply with quote

Hi all!

I have been riding a CBF 125 since January this year on L plates, am currently doing lessons in preparation for mod 2.

I am using my bike as a daily commute from Welwyn Gdn City to central London. On the way home today, a guy turned into a side road across the front of me without indicating, had to brake due to someone crossing the road and I hit his back left side and came off. He got out, shouted something abusive about learners and bus lanes, got back in his car and drove off without giving me any details or anything....

I have his reg plate and know the car make/model/colour etc, and was just wondering what the best course of action is? I feel like I should phone the local police to report the accident, and also my insurance to report it but not claim (yet).

I am uninjured, and the bike for the most part looks okay, but I will check tomorrow when it's light.

Any advice on anything I should do/not do/say/not say to police/insurers would be great. Thanks!

He's failed to stop at the scene of an accident which is an offence

Was there any damage to the car?
If no damage was done to either party I don't suppose you are obliged to report it.

His rear light was smashed and my bike is making a weird noise - I will check further in the morning. I thought I was obliged to report it as he didn't give me any details.

The reason why he fucked off despite the fact you broke his rear light is because he probably doesn't have a licence/insurance.

I'd be tempted to report it to the police.

Did he clock your number plate before fucking off? He may be planning on saying that you fucked off....

By the way, the highway code says that you mustn't enter a yellow box unless your exit is clear (oncoming traffic stopping you from turning right is an exception) and so he shouldn't have been in the box if a pedestrian was crossing anyway, cutting across a lane of traffic is also a big no-no.

No-one in their right mind fucks off after an accident unless they have something to lose. Report it.

Hope your bike is fine. What sort of 'funny' noise is it? Check round the whole of the front wheel incase something is rubbing against it.

Kind of a clicking noise like something is loose, I couldn't see what it was and couldn't get it to stop by resting my hand against anything - maybe something was rubbing the front wheel, didn't consider that. Thanks!

Push the bike without the engine running. If you still hear the ticking noise it,s probably a wheel (and even more likely the front from your collision)

Check the whole wheel round the circumference from rim to spindle. It could be anything from a mudguard bent and touching to a bit of his light caught up.

See if you can lift up the front so you can spin the wheel with your hand. That'll mean that you can get your head near the wheel and listen to where the noise is coming from. If you have long hair, tight it back first....

Looks like a spycam-on-a-pole to the south, should have a nice view of it.

No witness details though? Nobody bothered to see if you were OK? Laaahndahn. Rolling Eyes

What I expect: police will do sod all, your insurer will rape you if you report it to them, even as an FYI rather than a loss.

Unless you can actually find some significant damage to your bike, might be as well to just shrug that one off. You should report it to a copper though, to cover your own back and to make their numbers look worse. It doesn't have to be down the cop shop, you can bag a constable on the street, although he/she/it might not know that.

I noticed on the streetview the signs do not allow motorcycles to use the bus lane. Have the signs been changed now?
If they haven't - will it be an issue and would you call police if it was you?

I believe that London bus lanes were out of bounds to bikers until a few years ago.

WHEN did this happen? (what time)

That bus lane is active between 4 and 7 pm Monday to Friday. I seen no left turn filter for it at that junction so if it was active, I strongly suspect you should not have been there. There are no motorcycles shown on the sign about 200yds back up the road.

That said, still report the collision to the police. They are almost certainly not interested but if the car driver suddenly notices it's going to cost him £££ to fix his taillight and reports you, you covered your arse. You need a log number, then you have fulfilled your legal duty to report an accident.

Next time - lie on the ground unmoving with fake blood dribbling from every orifice. But make sure your head is in a position where you can see car's number plate.

Exactly this ^^^

Assume if OP was coming home then it would have been between 4 and 7pm and should not have been in the bus lane.

What you aren't taking into account is that you have no idea how long ago the streetview pictures were taken. If it was before January 2012, then bikes weren't allowed in bus lanes in London.

As of January 2012, bikes were allowed. Need the OP to state whether or not the signage shows motorbikes now or not.

Lets just hope it's a really expensive car. Somebody at work has a BMW 3 series and reversed into something and destroyed a light. £400 replacement.

Those who are saying about it being a given that bikes are allowed in bus lanes in London are incorrect, it is only red route bus lanes that motorcycles are 100% allowed in. Many other bus lanes do allow motorcycle use however if the road is not a red route then you still need to check the signs.

They will not be bothered if company/lease car. It'll be covered on expenses and probably a tax right-off.

Yep, beat me to saying this. Make sure you check the signs as some non-red routes don't allow us. That one on the map isn't a red route and the sign (from July 2012) says no (during prescribed hours).

This type of incident is one of the reasons fro taking great care if legally in a bus lane and passing moving traffic to the right

I for one would not pass anything that is moving above a few miles an hour on the left

Yes if and I don't think this bus lane Is motorcycles allow it may be legal but it is not a move I would advise and I think it could depending on the speeds involved be Careless driving
The car turning Left without indicating also could be said to be careless but his defence will be Motorbike are not allowed in the bus lane so I didn't expect him to be there of going so fast as to be unable to stop when I got caught out by the pedestrians

I think you going to have to take this one on the chin and be glad the car driver is not after you to pay for his damage

We all make mistakes try to learn from them

Take care out there

Dave

Motorbikes have been allowed in some bus lanes since before January 2012 as as part of two trials; red routes and some other bus lanes depending on borough. January 2012 is just when it became permanent.

Generally you always need to check the signs though, as even some red routes have portions that don't allow motorcycles. I'm thinking of the bus stops in front of Kings Cross on Euston Road in particular.

Not expecting something to be there is not an excuse for not looking, it was a bus lane, so at the very least he should be expecting that there could be a bus in it.

I'm not a southerner, but up north taxis and cycles are allowed in bus lanes, as well as motorcycles in most.

Call the police do it sooner rather than later he commited a crime.

If he had damage and it was your fault don't you think he would have stuck about.

Kudos on the paint diagram Thumbs Up
