So like the mong I am, I got caught speeding past a van doing 36 in a 30, wont someone think of the children!? kittens were killed, it was an ordeal etc.

I really can't be arsed to contest it, I hear I'm in for £100 and 3 points?
I also heard that 6 points on provisional and they take it off you.
Main question being, wouldn't I simply be able to apply for a new provisional license with the DVLA, do CBT again, and back on the road? or am I missing something? (aside from an ability to avoid speed traps).
I am slightly concerned that I may get done for such a small infraction again, or may have been done again in the time they sent this letter!

You can actually get up to 12 points on a provisional before a ban/revocation.

It's 6 points for the first 2 years of getting your full licence.

The 6 point limit is for the first two years after passing your first full license test. If your license is revoked then you can apply for it again and you'd be back to a provisional.

On a provisional you've got 12 points to play with.

As everyone else has said, you've got 12 points if you're on a provisional+CBT.

What would be kind of interesting would be, if the provisional got revoked - and you applied for it again! - whether your existing CBT was still valid. I wouldn't be surprised if there's no actual process for them to revoke a CBT that was correctly issued... Thinking

(I can understand you might not want to test this out!)

You'll be probably entitled to the speed awareness course if they do it in your area. You'll pay around the same cost as the fine, but if you attend you won't get the points.

Being a van, you *might* get away with it. Don't hold your breath too much, but they won't have your plate if the camera was front facing. It only takes a bit of laziness on the part of the operator for nobody to have manually recorded your plate.

Of course, if you were stopped at the scene or already received paperwork then your chance is gone and your gonna get raped.

Well then you should be more careful!

You only get one speed awareness course offer in a 3 year period.

Police Guidance on the courses is here if anyone is interested:

Savings minus the travel cost to some DVLA driving centre and the inevitable fast food lunch you'll get on the way/way back. You may get some single hockey-mum's phone number while on the course, but she is going to cost you an arm and a leg over a couple of months of dating. Then she'll make you start buying the kid stuff and taking it out to places.

And if you do go, you listen to a policeman tell you, for 2 hours, how 30mph saves the little girl and her teddy bear but 40mph kills her.

You are inevitably the one that makes a (hilarious) sick joke, but nobody thinks it's funny because "omg, we're all here for a reason".

No, not worth it if you ask me.

I think this is a situation where a speed awareness course IS worthwhile if offered.

OP is on a provisional and presumably wants to do his test sometime soon.

Those points will be on his licence for the next three years so if he passes his test then gets done once more in that three years, he triggers the new drivers act and is back to square one with no licence.

A speed awareness course would mean he still has six points to play with.

I agree with others that I probably wouldn't do one for a minor speeding offence but three points wouldn't put me within a bald tyre of losing my licence.

All that said. Have you had a Notice or Intent to Prosecute (NIP) yet, either verbally at the scene or through the post? If not, keep your fingers crossed for the next 14 days because if they haven't sent one by then, you're pretty much home and dry.

Motorcycles aren't the easiest thing for them to get a good "ping" off with their laser and also have no front numberplate which means they need a camera facing the other way too to catch you going past.

Not a policeman, it's a course run by the AA.

Alcohics anonymous Shocked Laughing

I've got in the sights of scamera vans at silly speeds more than oncw but the only time I have been done for speeding was a copper on a flyover and a squad car on the slip road.

I recon 90% of the scamera van operators can't be arsed to swing round and photo a bike numberplate. Why bother when you will catch enough cars to get your quota without evep putting your burger down. Rolling Eyes

I am sure that's a slander and a slur against the camera operators. These people aren't even in the police and I believe they also eat McDonalds wraps in their scamera vans Wink

On topic, as said sit tight and wait for the NIP.

Wait, what?! I've been riding around all this time worrying about getting caught speeding and losing the license...

I though on a CBT if you got caught doing anything wrong it's instantly revoked. Question Exclamation

Nah...I've currently got four points for speeding (along with a £250 fine...thieving cnuts) and I still have another eight points to play with (joke, as I learned my lesson) and it didn't affect my CBT, just my bank balance and a lot of butthurt. Sad

Yeah that does seem strange logic that on prov you can get 12 points, slightly reassuring tho.

I should have been clearer, I got done on my CG going past a speedvan, and I already received the first letter asking if it was indeed me who killed said kittens.
Oh yeah and I think the reason I got screwed this time is because the van was outside a primary school... 100metres from the road... and the school has a 15ft cage around the perimeter, clearly a huge danger!

I already filled it out, was about to send it off (I'm 14 days into the 28 day timeline).
Can anybody tell me the best way to send the letter to these fucks?

I was about to send it via recorded delivery as I am a worry'er and don't trust the postal service to deliver without losing it, but apparently you cant send recorded to a PO Box??

Do you get any kinda of grace period past the 28 days too, or if the postal service fuck up am I instafucked?

halp!

Yeah because 36 in a 30 is death defying stuff regardless of the context of the road.

Even at 3am it's still 30.
Speeding laws are dumb.

Just get proof of postage, all you need, don't even bother doing it recorded. Send it off right at the end of the time, no point rushing to get points Laughing

And you didn't see it? You don't deserve a licence if you are that un-aware of whats happening around you.

Good job you don't make that decision then isn't it.
It also hides behind a bush often, thanks for making assumptions tho.
