Had my first off this morning Sad
Basically the car in front got cut up on a roundabout, slammed the brakes and I hit him. Fairings are cracked and brackets are bent so guessing the bike is a write off.

The problem is, Im covered but my policy is Social and domestic pleasure and my details are an unemployed full time student. Ive only just got a job for summer and hadn't informed my insurer of my change of circumstances. Any ideas of whats likely to happen? Not expecting any kind of pay out on the bike anyway because of excess and Im TPFT and seeing as I hit a vehicle from behind Im instantly liable.

Meh, it's usually the case that if you're unemployed you pay MORE. So you getting a job might not have caused an increase in premium anyway. Don't mention it to them whatsoever. Keep quiet and don't say you were driving to work if you don't have commuting. As you're not claiming yourself and you know you're going to be found at fault, keep your communication and cooperation to a minimum.

You weren't on the way to work though, were you?

I thought you were on the way to Tesco, no?

You can see here approaching the roundabout from the left of the picture, the right lane is right turn only. The car decided last minute he was going straight on so the car in front of me had to brake hard and I had nowhere to go.

It's up to them to prove you weren't on the way to Tesco, not up to you to prove anything at all. You could, of course, just have been out for an early morning ride before work.

If you did happen to be commuting on a policy that doesn't cover you to commute, I believe they will settle the 3rd party side of the claim as per usual, and then can seek to recover the costs of the claim from you afterwards, whether they bother or not is another question.

Given my trust of insurance companies to try and extract every penny out of us, I think I would have been going shopping on this occasion.

More likely the ride of shame at that time.

On a totally unrelated note, it was the North Devon MAG's bike show today. Sounds like a lovely day out, but you'd probably have had to set off quite early if you fancied going.

The karma you get from manning up and accepting liability more than counters any misrecollection about the purpose of your trip. Thumbs Up

Insurance doesn't become invalidated over such minor details

Say for example, you get the date of birth wrong (by days or a month) on your policy, or you put slightly the wrong employment information, this does not invalidate your policy. Worse to worse, the difference between your current premium and what the premium would be if the information was correct, would be taken from the claim

There's more information about this on the insurance ombudsman website

OP you should hang your head in shame. 9 years on BCF and presumably 9+ years of riding and this is your first crash? Should be trying harder.

You state that as unqualified fact with great confidence.

We are specifically discussing commuting use though, and so I took the liberty of examining this issue. I discovered the only reason that your supposition had been sitting on its perch in the first place was that it had been nailed there.

The top hit in FOS decisions is this clear decision in favour of the insurer which flatly refutes your assertion that non-disclosure of commuting use is a "minor detail".

I'd be willing to bet my bollocks that insurance has been invalidated for less.

As implied above (sort of), insurers will argue that you were not covered for that nature of riding and will get out of paying etc. It does say on just about every insurance doc I've ever possessed that false details MAY result in invalidated cover, irrespective of the size of detail (minor, major, what?). I would absolutely not take that chance.

So what did you get from Tescos?

To be fair, he's half right. OP only has TPFT cover, so the insurer is only on the hook for damage to the third party, which they can't get out of irrespective of the lack of commuting cover.

That being said, they CAN still cancel the policy, and if they want to be dicks about it, they can pursue OP to recover anything they have to pay out. Also, if plod were having a particularly bad day, they could do him for riding without insurance. So at the time of the accident, it's very important that OP was not commuting.

What mathewculver actually wrote was - in the context of declaring commuting use - all wrong.

There's a nuanced "yehbut" there, but he didn't choose to explore it, so I'm not going to cut him any slack.

Making an assertion like that and presenting it as unqualified fact to an audience that might be daft enough to believe him and act on it doesn't incline me to "be fair". It gets my dander up, and no mistake.

You're talking more along the lines of innocent misrepresentation protection rather than a straight forward case of not having the appropriate cover. The two are very separate.
